Kennzeichen-Scanning in vielen Bundesländern soll verfassungswidrig sein

Die Art der Erfassung von Kfz-Kennzeichen durch das sogenannte Videoscanning ist einem Gutachten zufolge in fast allen Bundesländern, die dieses Verfahren anwenden, verfassungswidrig. Nach dem am 29. Januar in Berlin vorgestellte Gutachten des Kasseler Rechtsprofessors Alexander Roßnagel halten sich die Bundesländer nicht an die grundrechtlichen Vorgaben. De ADAC hat das Gutachten in Auftrag gegeben.

EU-Kommissar Frattini und Schäuble wollen Erhebung von Fluggastdaten

In der Sicherheitspolitik bahnt sich neuer Streit zwischen Bundesjustizministerin Brigitte Zypries (SPD) und Bundesinnenminister Wolfgang Schäuble (CDU) an. Anlass ist das von EU-Innenkommissar Franco Frattini geplante europäische System zur Erhebung und Auswertung von Fluggastdaten. Während Zypries am 29. Januar diese Pläne als Schritt in Richtung "Präventionsstaat" zurückwies, verteidigte Schäuble das Vorhaben als ein zusätzliches Sicherheitsinstrument. Frattini behauptet, ein Missbrauch der persönlichen Daten solle ausgeschlossen sein. Nach den Vorstellungen der EU sollen künftig 19 Passagierdaten von allen Fluggesellschaften erhoben und für die Auswertung nationaler Sicherheitsbehörden zur Verfügung stehen. Ferner ist eine Speicherung dieser umfassenden Datensätze für 13 Jahre vorgesehen. Zudem soll eine präventive Risikoanalyse der jeweiligen Passagiere erstellt werden können.

„Als „in erschütternder Weise verfassungswidrig“ charakterisiert die Neue Richtervereinigung den Gesetzesentwurf zur Begrenzung der Prozesskostenhilfe, der nach der Sommerpause vom Deutschen Bundestag verabschiedet werden soll. Mit der Absicht, die Ausgaben für das früher so genannte Armenrecht massiv zu reduzieren, verletze der Entwurf Grundgesetzartikel, wonach jedem Bürger effektiver Rechtsschutz zu gewähren sei. Auch die Gewerkschaft Ver.di protestiert und sammelt Unterschriften dagegen. Sie vermutet, das „Kostendämpfungsgesetz“ richte sich besonders gegen Hartz-IV-Empfänger, die gegen ihre Bescheide klagen und dafür Prozesskostenhilfe benötigen. Für Betroffene geht es buchstäblich ums Ganze. Lebensjahr, die seit einem Jahr kein Jobangebot mehr erhalten haben, künftig automatisch aus der Arbeitslosenstatistik gestrichen werden. Aus einer Option, die ältere Langzeitarbeitslose bisher schon freiwillig wahrnehmen konnten, würde damit der Regelfall. Und im Klartext die Botschaft: Wer als Älterer keinen Job mehr findet, ist nicht mehr arbeitslos, sondern für den Arbeitsmarkt schlicht unbrauchbar. Like other candidates, she pledged not to campaign in Florida after the state jumped ahead on the schedule of caucuses and primaries set by the Democratic National Committee. She had to make that pledge if she hoped to compete in the first-in-the-nation Iowa caucuses and the first-in-the-nation New Hampshire primary, as Iowa and New Hampshire zealously guard their starting status on the political calendar. But Iowa and New Hampshire are history and, after a landslide loss in South Carolina on Saturday, Clinton needs a win. So she has begun appearing in Florida in anticipation of Tuesday’s Democratic primary there...

Homegrown Terrorism Prevention Act is scary stuff

There is a new anti-terrorism bill in Congress, and this one could take our nation to a place it has never been before. The Violent Radicalization and Homegrown Terrorism Prevention Act of 2007 passed in the House in October. It contains enough vague and general language to threaten the freedom of every U.S. citizen, yet it was approved, 404-6. The lopsided vote reminded me of two other resolutions that were adopted with overwhelming support. The combined vote on the Tonkin Gulf Resolution that started the Vietnam War was 502-2. The vote to kick the Iraq war in gear was a more contemplative, but still one-sided, 374-156. Most of the complaints about Congress lately have centered on the divisiveness and failure to compromise on most issues. I think near-total agreement should throw up a red flag, too...

President Bush was set to act Tuesday on his State of the Union promise to sign an executive order directing federal agencies to ignore any future earmarks not voted on by Congress. Bush warned lawmakers he would flourish his veto pen if Congress does not rein in the number of congressional earmarks — money set aside for pet projects — that make it into law without a vote. As many as 95 percent of earmarks are inserted after Congress has voted on appropriations measures, and the pork is never seen by most lawmakers. Bush called on Congress during last year’s State of the Union to cut the number of earmarks in half, but Monday night he chided lawmakers for failing to do so...
