17th Amendment Federal Right to Elections
I just discovered that the 17th Amendment provides a Federal Right to Elections for the US Senate.

The 17th Amendment says:
Clause 1. The Senate of the United States shall be composed of two Senators from each State, elected by the people thereof, for six years; and each Senator shall have one vote. The electors in each State shall have the qualifications requisite for electors of the most numerous branch of the State legislatures.
Clause 2. When vacancies happen in the representation of any State in the Senate, the executive authority of each State shall issue writs of election to fill such vacancies: Provided That the legislature of any State may empower the executive thereof to make temporary appointments until the people fill the vacancies by election as the legislature may direct.
and federal case law seems to establish a federal "right to vote" and the right to have those votes accurately counted. (see pp. 8 to 16 in this complaint)

Yet, how can the public have a right to "have votes accurately counted in elections" when votes are counted secretly in a "back-room" process and virtually all election records necessary to verify the integrity of vote counts are kept secret, as they are in some states like Utah, and when those votes are also cast and counted secretly by using invisible e-ballots and trade secret software controlled by private companies, without any valid independent public manual audits of the machine counts?

If House Resolution 811 (which requires valid independent public manual post-election audits and pre-printed paper ballots at all poll locs to prevent voter disenfranchisement by electronic failure or power outages) does not pass in time for the 2008 election, then the only option to protect the 2008 election from fraud and outcome-changing error, may be costly legal means to try to obtain a measure of public control over the election process.
Please give it one more shot to contact your US House representative about supporting H.R. 811, with its 2008 deadlines for election audits in tact. H.R.811 would save States much money in the long run due to its encouraging the use of far less expensive paper ballot systems, rather than providing unnecessary high-tech toys for each poll booth to do something that takes able-bodied voters about ten minutes once/year to do on paper.
