BKA-Gesetz stößt auf Ablehnung der Opposition und zum Teil bei der SPD

Die Bundesregierung stößt mit der geplanten Neuregelung der Befugnisse des Bundeskriminalamtes (BKA) weiter auf einmütigen Widerspruch der Opposition. Auch die SPD meldete erneut Nachbesserungsbedarf an. Mit dem Gesetz soll das BKA künftig unter anderem die Befugnis zu heimlichen Online-Durchsuchungen von Computern sowie zur optischen und akustischen Wohnraumüberwachung erhalten. Grünen-Chefin Claudia Roth forderte die Bundesregierung auf, das Gesetzgebungsverfahren "umgehend auszusetzen". Der frühere Bundesinnenminister Gerhart Baum (FDP) drohte mit einer Verfassungsklage gegen das geplante BKA-Gesetz. Dies sei notwendig, wenn der Gesetzentwurf in seiner jetzigen Fassung verabschiedet werden sollte, sagte Baum. Er bemängelte unter anderem, dass die Trennung zwischen Nachrichtendienst und Polizei nicht gewahrt bliebe.

Sicherheitsgesetze einer kritischen Überprüfung unterziehen!

Nach Auffassung von BKA-Präsident Jörg Ziercke ist eine Befristung und gründliche Evaluation des umstrittenen BKA-Gesetzes und der Online-Durchsuchung nicht erforderlich. Dazu erklärt LINKE-Vorstandsmitglied Jan Korte (MdB):

Ausgerechnet bei einem so hoch sensiblen Gesetz wie der Online-Durchsuchung lehnt BKA-Präsident Ziercke eine gründliche Evaluation und Befristung ab. Das finde ich höchst suspekt. Wenn sich Ziercke sicher ist, dass Online-Durchsuchung, Rasterfahndung oder Lauschangriff höchst notwendige Mittel im Kampf gegen den Terror sind, dann sollte er weder eine Befristung noch eine gründliche Überprüfung der BKA-Befugnisse fürchten. Mit dem neuen BKA-Gesetz werden die Grundrechte aller empfindlich angetastet. Eine Überprüfung, ob diese Befugnisse tatsächlich notwendig, angemessen und verhältnismäßig sind, ist eine Selbstverständlichkeit, über die man eigentlich nicht diskutieren sollte. DIE LINKE bleibt daher bei ihrer Forderung, alle Sicherheitsgesetze einer kritischen Überprüfung zu unterziehen. Lehnt der BKA-Präsident dies weiterhin hab, dann darf er sich nicht darüber wundern, dass ihm eine neue „Misstrauensdebatte“ droht. Eine Innenpolitik, die Hand an die Grundrechte legt und sich dabei nicht mal einer Prüfung unterziehen will, verdient nichts anderes als Misstrauen.

Das BKA sammelt Erkenntnisse über Menschen, die "Gefährder" genannt werden; das sind Menschen, die noch nicht auffällig geworden sind, die aber auf- und straffällig werden könnten. Wenn diese Gefährder dann wirklich gefährlich werden, kann man sogleich zugreifen - man verfügt ja über alle notwendigen Erkenntnisse.
