"Hochgradig ungerecht verteilt": Seehofer soll Empfänger von EU-Agrarsubventionen nennen (09.03.06)

Zahlreiche Nichtregierungsorganisationen haben Landwirtschaftsminister Horst Seehofer (CSU) aufgefordert, die Namen der deutschen Empfänger von EU-Agrarbeihilfen und die Höhe der jeweiligen Subventionen zu veröffentlichen. Die Menschen sollten erfahren, wer von den Subventionen profitiert. Es gehe in Deutschland um rund sechs Milliarden Euro Steuergelder. Seehofer solle dem dänischen und britischen Beispiel zu folgen. Die Veröffentlichung der Subventionsempfänger in Großbritannien hatte im vergangenen Jahr ergeben, dass Queen Elizabeth II. in ihrem eigenen Land am stärksten von den Agrarsubventionen der EU profitiert. In Deutschland kassieren offenbar 0,5 Prozent der Betriebe jeweils mehr als 300.000 Euro im Jahr und damit 20 Prozent aller Agrar-Direktzahlungen. Neben den Bauern sollen die Steuergelder auch Exporteuren von Agrarprodukten, Futtermittelkonzernen und der Agrarchemie zufließen.

'Monitors give off deadly radiation'

BABIES are being put at risk of cancer by hi-tech cot monitors which emit deadly radiation, it is claimed.

Parents will be horrified to learn that slow-pulsing microwaves blasted out by modern digital equipment may cause leukaemia, say scientists.

Lab tests have also linked the radiation to potentially fatal brain tumours, breast cancer, headaches and disturbed behaviour patterns in kids.

Consumer group Powerwatch has urged parents to ditch digital (DECT) monitors.

Boss Alasdair Philips said: "We don't recommend they are used. Do not put a wireless transmitter in your child's bedroom and irradiate them unnecessarily."

Emissions, even if the monitor is not in use, can reportedly reach six volts per metre-TWICE as strong as those found within 100 metres of mobile phone masts.

That's a similar amount given off by digital cordless phones, as we revealed this month.

Baby monitoring mats-which check a tot's temperature and breathing-are also a concern because it is claimed they can emit 120 TIMES the safe level of 0.05 volts per metre.

Digital products produce the radiation-but are popular because they provide clearer sound than old analogue monitors.

Expert Dr David Dowson said: "Until more research has been done, I would advise every parent not to use them."

One manufacturer said: "There's no scientific evidence linking radiowaves to symptoms."

CHILDREN may be at risk of cancer from digital baby monitors, parents have been warned.

The cordless gadgets, which allow babies' breathing patterns to be checked from another room, emit potentially dangerous radio waves even when not in use.

Consumer group Powerwatch warned parents against using them after research suggested the technology increased the risk of brain tumours.

There are also fears it is linked with leukaemia, breast cancer, headaches and disturbed behaviour patterns in children.

Digitally enhanced cordless technology is becoming more popular in baby monitors. But Powerwatch founder, Alasdair Philips, said: 'This technology poses a risk to everyone, but babies in particular should not be exposed to it at all.

'Babies are more likely to be effected because their cells are rapidly dividing as they grow and can be more easily damaged.'

Similar concerns have been expressed about cordless phones.

Last week, research found those who used digital mobiles or cordless phones had a higher chance of getting a benign tumour called acoustic neuroma, though similar studies have found no link.

Dr Michael Clark, of the Health Protection Agency, said he would be surprised if digital baby monitors and base units of cordless phones caused cancer because their electromagnetic fields operate at low levels and the devices are not held against the head.

Eine Berliner Rektorin will ein Handy-Verbot an der Neuköllner Helmholtz-Oberschule verhängen, weil die Schüler sich per SMS zu einer Massenschlägerei verabredet hatten. Das berichtet die Tageszeitung 'BZ' heute. Mobiltelefone sollen nach Vorstellung der Schulleiterin Hiltrud Rothaus dann weder im Unterricht noch in der Pause benutzt werden dürfen. Bisher gilt an vielen Schulen das Verbot nur während der Unterrichtszeit.

"Schon bei den kleinsten Meinungsverschiedenheiten holt man Verstärkung mit dem Handy", sagt Rothaus. In den ersten drei Monaten nahm die Jugendgruppengewalt stark zu. "Die Fallzahlen sind explodiert", sagt Oberstaatsanwalt Manfred Schweitzer von der Intensivtäter-Abteilung der Staatsanwaltschaft gegenüber der Zeitung. "Von Januar zu Februar stiegen sie um 30 Prozent, bis März noch einmal um 50 Prozent an." Gerade unter Jugendlichen mit Emigrantenhintergrund beobachtete die Polizei im vergangenen Jahr eine Zunahme bei "Rohheitsdelikten" um 10 Prozent, bei Gewaltkriminalität um 8 Prozent.

In ihrem Brief wandte sich Schulleiterin Rothaus an die Eltern: "Bitte sprechen Sie mit ihren Kindern. Jeder Schüler, der solche Anrufe tätigt, ist mit dafür verantwortlich, dass derartige Massentreffen stattfinden." (as)

Kultusminister erwägt Handy-Verbot an Schulen

München (ddp-bay). Nach mehreren Fällen von Gewaltvideos auf Mobiltelefonen von Schülern denkt Bayerns Kultusminister Siegfried Schneider (CSU) über ein generelles Handy-Verbot an Schulen nach. Schneider sagte am Dienstag dem Hörfunksender Antenne Bayern, sein Ministerium prüfe, welche Verordnungen oder Gesetzesänderungen für ein Handy-Verbot notwendig seien. «Ich will nicht voreilig reagieren, aber wir sollten ein Thema nicht zum Tabu erklären», betonte der Kultusminister.

Nachdem die Polizei vor kurzem unter anderem an einer Schule in Immenstadt im Allgäu rund 200 Handys mit verbotenen Inhalten beschlagnahmt hatte, rechnet der Minister mit weiteren Fällen. Er wisse nicht, ob dies nur die «Spitze des Eisbergs» sei, sagte der Kultusminister.

Ähnlich äußerte sich die bayerische Sozialministerin Christa Stewens (CSU). Auch sie kann sich ein Handy-Verbot vorstellen. Die Gewaltvideos gefährdeten Jugendliche in ihrer psychischen Entwicklung, warnte Stewens. Als erste Vorsichtsmaßnahme schlug die Ministerin vor, dass Eltern ihren Kindern Handys ohne Foto- und Videofunktion kaufen sollten.

Zugleich appellierte Stewens an die Eltern, genauer hinzusehen, was ihre Kinder sich auf das Handy geladen hätten. «Es erschreckt mich immer, dass 60 Prozent der Väter und 30 Prozent der Mütter nicht wissen, mit was sich ihre Kinder beschäftigen», sagte Stewens.

Der Mietvertrag sei eine Konzession. Mit diesem neuen Argument focht die römisch-katholische Kirchgemeinde Erlinsbach SO vor Zivilgericht in Olten gegen die im Kirchturm geplante Mobilfunkantenne. Das Gericht wird erst später entscheiden, wie es in der Mietfrage weitergehen soll.

Sie fühle sich am Ende ihres Lateins, musste Amtsgerichtspräsidentin Eva Berset eingestehen. Verhandelt wurde dort auf der Zivilabteilung am Richteramt Olten-Gösgen über die Kündigung des für eine Mobilfunkantenne im Kirchturm von der Kirchgemeinde mit Orange abgeschlossenen Mietvertrags.

Dieser war im Sommer 2003 vom Kirchgemeinderat unterzeichnet worden. Nach Bekannt werden der Pläne für die Antenne schlugen die Wogen hoch. Aus der Bevölkerung wurde starker Widerstand laut. An der Kirchgemeindeversammlung am 1. Juni 2005 wurde der Kirchgemeinderat schliesslich beauftragt, den Mietvertrag aufzulösen, was er per Ende 2005 auch tat.

Dagegen wehrte sich Orange zuerst vor der Mietschlichtungsbehörde und nun auch bei der Aussöhnungsverhandlung vor Zivilgericht.

«Faktisch 21 Jahre unkündbar»

Der Rechtsvertreter der Kirchgemeinde betonte dabei, dass diese als Klägerin nicht antrete gegen die Feststellung der Schlichtungsbehörde, wonach keine «wichtigen Gründe» für eine Vertragskündigung vorlägen. Er verlagerte die Argumentation vielmehr auf eine neue Schiene und setzte bei der langen Wirksamkeit des Mietvertrages an.

Dieser räumt Orange ein festes Nutzungsrecht für den Kirchturm bis Ende 2013 ein und gibt der Mobilfunkbetreiberin das Recht, dieses anschliessend zweimal um weitere fünf Jahre bis Ende 2023 zu verlängern.

Aus Sicht des Vermieters liege «also faktisch eine unkündbare Mietdauer von 21 Jahren vor», unterstrich der Anwalt der Kirchgemeinde. Dies komme «der Einräumung eines beschränkten dinglichen Rechts nahe», womit der Kirchgemeinderat «erkennbar nicht zuständig» gewesen sei für dieses Geschäft, argumentierte der Rechtsvertreter.

«Sondernutzung» sei Konzession

Dieser betonte weiter, dass der Kirchturm mit dem Einbau einer Mobilfunkantenne eine «Sondernutzung» erfahre. Die Verleihung «des Rechts zur Sondernutzung an einer öffentlichen Sache» an Private sei wiederum eine Konzession. Für die Behandlung von Rechtsfragen in diesem Falle sei das Zivilgericht gar nicht zuständig.

Damit sorgte der Anwalt der Kirchgemeinde nicht nur bei der Adressatin, sondern auch beim Vertreter von Orange für Verblüffung. Wie Martin Eggen betonte, sei dies eine «ganz neue Idee», zu welcher er sich im Moment nicht näher äussern wolle, welche aber klar bestritten werde.

Doppelnutzung als Stolperstein?

Auf die Frage der Gerichtspräsidentin, ob es keine Alternativstandorte gebe, wies der Rechtsvertreter der Kirche auf das zweite Mobilfunkantennenprojekt in Erlinsbach SO hin, dem sich Orange anschliessen könne. Das sei aus strahlungstechnischen Gründen nicht möglich, sagte Eggen, da Orange schon zusammen mit Swisscom im Kirchturm Mühe habe, die Grenzwerte einzuhalten. In dieser (für ihn neuen) Doppelnutzung sieht der Kirchenanwalt eine Vertragsverletzung, auf die er sich im weiteren Verfahren «stürzen» werde. (mz/atp/mlu)

The Florida Fish and Wildlife Conservation Commission is recommending that manatees be downlisted from endangered to threatened status on the state level.

Last year was the second highest manatee mortality year on record. Just in the last five years, 1682 manatees have died in Florida waters and of those, 398 were killed by boats. That is almost an 18% increase over the previous five-year period. Furthermore, state scientists estimate the manatee population could drop by half in the next 50 years because of habitat loss, red tide poisoning and boat collisions. The population is far from stable.

Manatees are poised to be downlisted regardless of how they are faring in the wild because of a calculated effort by special interest groups opposed to boat speed zones and restrictions on development.

Later this summer, the FFWCC will vote on this issue. If the commission approves, restrictions that have kept in check boat speeds, seawalls, docks and waterfront home-building could be diluted or eliminated. Urge Governor Bush to take a stand and keep protections for the manatee in place!

Weil RFIDLexikon-Tags (Radio Frequency Identification) künftig im Alltag allgegenwärtig werden dürften, müssen möglicherweise verschiedene Gesetze angepasst werden, teilt die Europäische Kommission mit. vor diesem Hintergrund lanciert sie eine Umfrage unter den Bürgern der EU-Länder. Dabei will sie erfahren, ob RFID ihnen in Bezug auf Datenschutz und -sicherheit zu denken gibt. Im Juni sollen diverse Workshops in Brüssel druchgeführt werden, in denen sich die öffentliche Meinung herauskristallisieren soll. Die Ergebnisse sollen in ein Konsultationspapier einfliessen, das im September veröffentlicht wird.

Der Schutz persönlicher Informationen ist bereits Gegenstand eines EU-Gesetzes, der so genannten "E-Privacy"-Direktive. Je nach Ergebnis der RFID-Umfrage wird dieses erweitert werden müssen, erklärt Brüssel.

EU prüft RFID auf Datenschutz

(13.03.2006) • Die EU-Kommission will den Datenschutz bei der Anwendung von RFID-Funkchips prüfen.

RFID-Chips sollen unter anderem im Einzelhandel den Strichcode ersetzen. Problematisch ist, dass sie per Funk und unter Umständen unbemerkt ausgelesen werden können und deswegen gegen den Datenschutz verstoßen können.

EU-Kommissarin Viviane Reding sagte auf der CeBIT, eine öffentliche Konsultation zum Thema RFID eingeleitet zu haben. Es sei zu überprüfen, ob die „E-Privacy“-Direktive der EU in Bezug auf RFID angepasst werden müsse. Wichtig wären allgemein akzeptierte Standards, die nicht nur die wirtschaftliche Effizienz, sondern auch den Schutz der persönlichen Daten berücksichtigten. Ob die Politik aber überhaupt intervenieren müsse, soll nach der nun eingeleiteten öffentlichen Diskussion geklärt werden. Dazu soll eine Umfrage unter EU-Bürgern sowie Workshops durchgeführt werden.

Literatur:

B) Studie des Bundesamtes für Strahlenschutz, ausgeführt vom IMST unter Leitung von Dr. Bornkessel, Zwischenbericht 09.07.04:

Entwicklung von Mess- und Berechnungsverfahren zur Ermittlung der Exposition der Bevölkerung durch elektromagnetische Felder in der Umgebung von Mobilfunk-Basisstationen

Verlauf der Leistungsflussdichte in Abhängigkeit vom lateralen Abstand (Höhendifferenz Sender-Empfänger 5 m) – siehe Anhang. Bild 2.2.15 in 1.B; identische Abbildung 3.6 in 1.A.

Ansatz: bis ca. 80 Meter vom Sender weg wird aufgrund von Nebenzipfeln eine ca. konstante, hohe Strahlung gemessen (und auch theoretisch gerechnet). Erst in ca. 210 Metern Entfernung ist die Strahlenbelastung auf 10 % des hohen Wertes abgesunken. Dieser Wert wird genommen als Grenze des „Sensiblen Bereiches“, innerhalb dessen kein Sender stehen sollte.

Aus dem Verlauf der Strahlung können vier Schlussfolgerungen gezogen werden:

1. Es gibt direkt unter dem Mobilfunksender keinen Bereich mit geringer Strahlung – die Bewohner des Hauses, auf dem der Sender steht, sind maximal belastet (die Mobilfunk-Betreiber behaupten immer noch das Gegenteil).

2. Viele kleine Sender in der Stadt machen keinen Sinn, da damit die gesamte Stadt hoch belastet wird. Es sollten hohe Sender weit weg von der Wohnbebauung installiert werden, um die Strahlenbelastung der Bevölkerung zu minimieren.

3. Realistischerweise kann erst ab einer Entfernung von ca. 210 Metern davon ausgegangen werden, dass die Strahlung eines einzelnen Senders gegenüber dem Maximalwert deutlich abgenommen hat.

4. Da außerhalb dieser Zone die Strahlung mit dem Quadrat des Abstandes fällt, vergrößert sich diese Zone bei 4 gleichen Sendern um den Faktor 2, bei 9 gleichen Sendern um den Faktor 3, usw.

2) Definition „sensibler Standort“

Nun haben die Mobilfunkbetreiber und die Bundesregierung in einer offiziellen freiwilligen Vereinbarung verabredet, dass „sensible Standorte“ gemieden werden sollen. Als sensible Zonen gelten offiziell nur Schulen und Kindergärten. Auch Altenheime und Krankenhäuser sollten dazugezählt werden, da hier verringerte Widerstandskraft vorliegt. Deshalb sollten Standorte für Mobilfunksender die oben angeführten Abstände zu sensiblen Zonen einhalten.

3) Neues Krankheitsbild im Umkreis von Sendern und DECT-Telefonen

siehe Anhang, Brief von Frau Dr. Waldmann-Selsam an den Bayerischen Umwelt- und Gesundheitsminister Schnappauf. Hochgerechnet auf Deutschland ergeben sich mehrere Zehntausend Kranke!

4) Forderungen der Bürgerinitative: Gesundheitsamt muss aktiv werden!

Die Bürgerinitiative sieht deshalb dringenden Informations- und Handlungsbedarf: Zunächst soll das Gesundheitsamt des Landkreises Rede und Antwort stehen, wie die sensiblen Zonen geschützt werden können. Die Bürgerinitiative sieht als einzige Lösung einen Rückbau der besagten Sendeanlagen und eine generelle Reduzierung der Sendeleistungen, vor allem in der Nacht.

5) Konkret: Brief der BI an den Bürgermeister

(direkt anwendbar nur für Bayern, da hier der „Mobilfunkpakt“ gilt)

Bürger fordern Informationsveranstaltung mit dem Gesundheitsamt wegen besorgniserregender Gesundheitsgefährdung der Anwohner von Mobilfunk-Sendeanlagen


Sehr geehrter Herr XX,

seit kurzem gibt es Ergebnisse einer Studie des Landes Nordrhein-Westfalen und des Bundesamtes für Strahlenschutz zum Thema Immissionen durch Mobilfunk-Sendeanlagen, wo gezeigt wird, dass eine hochbelastete Zone um jeden einzelnen Senderstandort existiert, und nicht ein deutlicher Abfall der Strahlung mit der Entfernung vom Sender. In YY führt diese neue Information dazu, dass fast alle Schulen und etliche Kindergärten in dieser hochbelasteten Zone liegen (siehe Anlage).

Wie Sie wissen hat die Bamberger Ärzteinitiative ein neues Krankheitsbild bei Belastung durch Schnurlostelefone (DECT) und Mobilfunksendern ermittelt und findet immer mehr Kranke. Aktuell liegt ein Brief dieser Ärzteinitiative an den Bayerischen Gesundheitsminister Schnappauf vor, in dem viele Krankheitsfälle beschrieben und eine akute Gesundheitsgefährdung für die Anwohner von Mobilfunk-Basisstationen festgestellt werden (siehe Anlage).

Diese beiden Punkte führen bei vielen Bürgern zu großer Besorgnis, da sie um ihre Gesundheit fürchten.

Wir fordern deshalb mit Bezug auf die Freiwillige Vereinbarung im Rahmen des Umweltpaktes II (Mobilfunkpakt II), Abschnitt 4.3, den verantwortlichen Arzt im Gesundheitsamt des Landkreises im Rahmen einer Informationsveranstaltung der Stadt zu dieser Thematik zu hören („… Ärzte der Gesundheitsverwaltung werden zum Thema „Elektromagnetische Felder – Schwerpunkt Mobilfunk“ regelmäßig geschult, um als fachkundiger Gesprächspartner für Wirtschaft, Kommunen und Bevölkerung zur Verfügung zu stehen“).

Wir bitten Sie, Herr Bürgermeister, diese Veranstaltung in den nächsten Wochen durchzuführen – laut Brief dieser Ärzteinitiative ist ein sofortiges Einschreiten der Behörden geboten.

Sehr geehrter Herr Hartenstein,

leider ist der gutgemeinte Abstandsvorschlag aus Wolfratshausen weniger
als die halbe Miete und so nicht zufriedenstellend anwendbar.

Nur theoretisch ergeben sich die genannten und auch grafisch
dargestellten Werte um eine Sendeanlage. Dabei darf aber nicht vergessen
werden, dass sowohl die Topografie als auch die Höhe über Grund und
weitere technische Einstellungen der Sektorstrahler eine ganz
entscheidende Rolle mitspielen. Nicht selten ergeben sich dann nämlich
ganz andere Feldstärkeverläufe. Der Laie (unter den Gemeinderäten,
Bauamtsleitern, Initiativgruppen etc.) berücksichtigt hier aber schon
allein die Höhendifferenz zwischen Sender und Aufenthaltsort
erfahrungsgemäß nicht und verlässt sich auf den "Sicherheitsabstand".

An einem Beispiel kann dies aufgezeigt werden: Messungen an einem Kindergarten (ebenerdige Bauweise) in ca. 90 und 120 Metern von einer Sendeanlage mit drei Sektorstrahlern entfernt "unterm Hauptstrahl" eines Sektors (gemessen jeweils im Garten mit Sichtverbindung zur Sendeanlage) und demgegenüber eine Vergleichsmessung in 200 Metern Entfernung (von Bäumen leicht verdeckte Sichtverbindung zur Sendeanlage, sonst freies Feld zum Kiga, seitlich dahinter die Sendeanlage) ergeben am weiter entfernten Messpunkt einen dreifach(!) höheren Messwert (erfasst mit Spektrumsanalyser). Mißt man hier in anderen Höhen über Grund oder ist die Sendeanlage niedriger montiert, bestehen sofort andere Verhältnisse an den beiden Messorten. Wäre beim geschilderten Fall der Kindergarten aber wie empfohlen mind. 200 Meter von der Sendeanlage entfernt gewesen, wäre die Strahlungsintensität dreimal so hoch. Die betreffende Gemeinde hatte bis dahin auch mit Abstandskreisen gearbeitet!

Ich möchte hier ausdrücklich vor einer "einfachen Abstandsdebatte" warnen - dies könnte nur ein erster Ansatz bei der Standortsuche sein - vernünftige Aufschlüsse ergeben entweder professionelle Messungen vor Ort (Spektrumsanalyzer) oder besser vorab Simulationen, die auch topgrafische (und in besonderen Fällen auch bauliche) Bedingungen berücksichtigen - leider ist die Hochfrequenzausbreitung nicht so
einfach gestrickt. Entsprechende Beispiele liegen vor, bei denen
"überraschend" hohe Werte nach über 200 Metern auftreten, weil z.B. das
Gelände steil ansteigt.

Den Begriff "Sensible Zonen" sollten wir als kritisch hinterfragende
Menschen schleunigst enttarnen: Was ist denn "unsensibel" an einem
Kinderzimmer oder Garten ums Haus, in dem die Kleinen 10 und mehr
Stunden spielend oder schlafend verbringen im Gegensatz zu Kindergarten
und Schule, in der Kinder je nach Alter vielleicht nur 3, 4 oder 5
Stunden täglich zubringen?

Residents in West Felton have welcomed news that a stop notice has been issued by the local authority to prevent the mobile phone company Orange carrying out further work on a mast.

However people living near the controversial mast, in fields close to homes at The Avenue, remain “guarded” about the future of the site.

Oswestry Borough Council believes the mast has not been put up in accordance with the permitted development rights allowed for certain structures.

It has issued the stop notice, informing Orange that it will have to dismantle the mast or submit a new application for permitted development rights.

A public meeting was held yesterday in the village near Oswestry for residents to hear from senior planning officer Edwina Smart and borough councillor Aggie Caesar-Homden.

Chairman of the parish council Pat Mabe said today: “People are pleased but we are concerned about what happens at the end of the temporary stop notice.”

On Tuesday Texas held its primaries for the 2006 elections, and with that kicked off what's likely to be one of the most tenaciously fought midterm election seasons in history.

"DeLay fights for his political life" - so read the headline for a Texas paper as all eyes turned toward Tom DeLay's primary battle. Now he's made it through, but not without being plenty bruised and bloodied in the process - in fact, 38% of Republicans voted against him. Everybody in his district and across the country knows that even his Republican support is waning, and now he has to go mano a mano with Democrat Nick Lampson, the strongest Democrat he's faced in decades.

And so the drama's begun. Over the coming months, state after state will hold their primaries, and the dogs will be unleashed. Democrats across the country will face attacks from Karl Rove and the gang; scandal-plagued Republicans will be outraged at accusations of unethical behavior as they keep one eye on any number of prosecutors on their tails; rank and file Republicans will grandstand, pretending to revolt against President Bush in hopes of convincing their voters that they aren't the obedient rubber stamps they've seemed to be for the past five years. It won't be pretty, and we won't let them get away with it.

So let's chat. I've enjoyed these online chats more every time, and I hope I'm getting better at answering all your questions and concerns.

Mehrklassenmedizin, Rationierung, Wartelisten mit tödlichen Folgen – was in vielen Ländern der Erde längst brutale Realität ist, wird auch in Deutschland mehr und mehr akzeptiert, schließlich sieht „jeder“ ein: Wer soll denn das alles bezahlen? Abgesehen davon, dass diese Frage beantwortbar ist: Viele Probleme liegen tiefer – man erkennt sie erst, wenn man sich in die Praxen und Krankenhäuser hineinbegibt – und sich die alltägliche Arbeit im Medizinbetrieb genauer ansieht. Natürlich werden die Erfolge des Medizinsystems hier nicht geleugnet, aber das moderne Gesundheitswesen tritt auf der Stelle. Es hat sich in vielen Bereichen zu einem Reparaturbetrieb reduziert; der Mensch wird immer mehr zu einem Bündel therapierelevanter Daten. Behandelt werden Symptome, nicht deren Auslöser - und das treiben nicht nur Pharmaunternehmen voran.

Das Wochenendseminar will nicht nur die Kostenseite beleuchten, sondern das komplette Gesundheitswesen in den Blick einbeziehen: Welchen Einfluss haben Lobbygruppen und Pharmaunternehmen? Welche Entwicklungen haben diese Gruppen zur Folge - und was entgeht den Bürgern dadurch? Welche Folgen haben ökonomische Zwänge (für Ärzte, Pfleger, PatientInnen)? Was wären Rahmenbedingungen für eine gesündere Gesellschaft, und was geht das einen Arzt an? Ist der Patient immer "unschuldig"? Und wie müsste ein zukunftsfähiges Gesundheitswesen gestaltet werden?

Dr. Harald Klimenta ist Physiker und studierte ebenfalls Volkswirtschaftslehre. Er lebt als Autor und Publizist in Regensburg und ist Mitglied im wissenschaftlichen Beirat von Attac Deutschland. Er arbeitet als Referent zu zahlreichen Themen, vor allem zur Sozial- & insbesondere Gesundheitspolitik. Klimenta arbeitet im Moment an einer Buchveröffentlichung zum Thema.

A former senior national security lawyer at the Justice Department is highly critical of some of the Bush administration's key legal justifications for warrantless spying, saying that many of the government's arguments are weak and unlikely to be endorsed by the courts, according to documents released yesterday.

David S. Kris, a former associate deputy attorney general who now works at Time Warner Inc., concludes that a National Security Agency domestic spying program is clearly covered by a 1978 law governing clandestine surveillance, according to a legal analysis and e-mails sent to current Justice officials.

Kris, who oversaw national security issues at Justice from 2000 until he left the department in 2003, also wrote that the Bush administration's contention that Congress had authorized the NSA program by approving the use of force against al-Qaeda was a "weak justification" unlikely to be supported by the courts.

The criticism represents an unusual public dissent by a former administration official over the legality of the domestic spying program, which allows the NSA to intercept international communications involving U.S. citizens and residents without warrants. The program, approved by President Bush in October 2001, was first revealed publicly in media reports in December and has been the focus of furious political battles since then.

Kris's views are contained both in a 23-page legal analysis that he provided yesterday to journalists and in a series of e-mails that he sent in December to Courtney Elwood, an associate counsel to Attorney General Alberto R. Gonzales. The e-mails were released yesterday by the Electronic Privacy Information Center, which obtained them as part of ongoing Freedom of Information Act litigation.

Justice Department spokesman Brian Roehrkasse played down the importance of Kris's opinions last night, saying that "it is not new that there are some who have disagreed with this analysis."

"Numerous lawyers with knowledge of the terrorist surveillance program have concluded that the program is being conducted in accordance with the law," Roehrkasse said.

Kris acknowledged in his paper that many facts about the program are not known, suggesting that he was not briefed on the NSA program despite his senior position at Justice during the first two years of its existence. But he says that many of the key arguments made by the Justice Department in favor of the program's legality do not hold up under scrutiny.

"In sum, I do not believe the statutory law will bear the government's weight," Kris wrote in his paper, dated Jan. 25. ". . . I do not think Congress can be said to have authorized the NSA surveillance."

Kris refrains from passing final judgment on the government's constitutional argument, however, saying that more facts need to be known to reach a conclusion. The Justice Department says in its own "white paper" that the Foreign Intelligence Surveillance Act, which governs clandestine surveillance within the United States, must be unconstitutional if it conflicts with the president's inherent authority during war.

Also yesterday, the Bush administration said that it will provide a briefing on the NSA program to a new subcommittee of the Senate intelligence committee but that details of how the new panel will conduct any further oversight have yet to be worked out.

Creation of the seven-member subcommittee is part of a plan by Sen. Pat Roberts (R-Kan.), committee chairman, that helped persuade Republicans this week to reject proposals for a Senate panel investigation of the NSA program.

White House spokeswoman Dana Perino said the new subcommittee will receive the same briefing the administration has provided in the past to the "gang of eight" congressional leaders, though the new group will not be allowed to share what it learns with other members of Congress.

Roberts and other Republicans on the committee also have endorsed a legislative proposal by Sen. Mike DeWine (R-Ohio) that would provide a statutory basis for the NSA program. It would permit warrantless surveillance of calls between the United States and another country for 45 days, after which the government could cease the eavesdropping, seek a warrant, or explain to Congress why it wants to continue without a warrant.

Perino said yesterday that White House officials are "supportive of the approach but need to work on the details" of the proposal.

The panel's vice chairman, Sen. John D. Rockefeller IV (D-W.Va.), said yesterday in an interview that the proposals fall far short of allowing Congress to make judgments necessary to oversee the program. "It is 'undersight' when they tell us what they want us to know," Rockefeller said, referring to the White House. "It's 'oversight' when we know enough to ask our own questions."

The Republican proposal would give Congressional approval to the eavesdropping program much as it was secretly authorized by Mr. Bush after the 2001 terrorist attacks, with limited notification to a handful of Congressional leaders. The NSA. would be permitted to intercept the international phone calls and e-mail messages of people in the United States if there was "probable cause to believe that one party to the communication is a member, affiliate, or working in support of a terrorist group or organization," The finding of probable cause would not be reviewed by any court.

Friends of the Earth Europe has today (February 28, 2006) published a leaked copy of the secret draft ruling in the World Trade Organisation (WTO) dispute over GM foods.

The US, Canada and Argentina launched a legal challenge against the EU in May 2003. They claimed that EU measures to protect consumers and the environment from the risks posed by GM food and crops were blocking trade in GM products.

Initial analysis of the report shows that despite claims of victory by the US government and the biotechnology industry, the US-led coalition failed to win many of their arguments against Europe. However, the WTO ruled that national GMO bans are illegal and it is likely that countries with bans in place will be put under renewed pressure to lift them.

A stop notice has been issued to prevent the mobile phone company Orange from carrying out further work on a phone mast in West Felton.

The controversial mast has been put up in fields at The Avenue in the village near Oswestry.

But Oswestry Borough Council believes the mast has not been erected in accordance with development rights allowed for certain structures.

It has issued the stop notice, informing Orange that it will have to dismantle the mast or submit a new application for permitted development rights.

Carol Corbett, a member of the West Felton Mast Protest Group, said the stop notice was issued after Orange cancelled a meeting with locals and the local authority and also moved to fix dishes to the mast.

She said: “We are holding a public meeting in the village hall at 7pm tomorrow.” Orange said it cancelled the meeting because of the short notice it was given.

Embarrassed that many health care workers choose not to follow CDC recommendations to get flu vaccinations every year, the CDC is urging hospitals to use more draconian measures to force them to get vaccinated. The most educated of all health care professionals treating the sick, health care workers have long been reluctant to roll up their sleeves and get vaccinated. Nurses in Washington state have gone to court - successfully - to block attempts by hospitals to force them to get vaccinated or be fired. Bottom line: the right to voluntary, informed consent to vaccination should apply to all citizens - including health care workers. Everyone should have the right to weigh the benefits and risks of vaccination for themselves or their minor children and make an educated choice.

US urges hospitals to vaccinate workers for flu

"Hospitals and nursing homes should offer free flu vaccines to all their workers and make employees sign a form if they refuse to be immunized, the U.S. Centers for Disease Control and Prevention said on Thursday.

As part of a drive to vaccinate more healthcare workers the CDC also said in a statement that shots should be made available to employees day and night. (...)

Surveys show that only between 36 percent and 38 percent of health care workers get an annual flu shot, even though they have a higher-than-average risk of being infected and can pass the virus on to vulnerable patients. (...)"

Peter Fletcher, ehemaliger Leiter der wissenschaftlichen Abteilung des britischen Gesundheitsministeriums und ehemaliger medizinischer Sachverständiger des Impfkomitees, hat in MAIL ON SUNDAY vom 5. Februar 2006 die britische Regierung in Sachen MMR der "absolut unerklärlichen Gleichgültigkeit" bezichtigt

Als Gutachter in Schadensersatzprozessen habe er Tausende von Impfschadensberichten durchgesehen, die im Grunde der Öffentlichkeit zugänglich gemacht werden müssten. Es gebe aber einflussreiche Leute in wichtigen Positionen, die sich mit ihrer Reputation und Karriere für die Sicherheit der MMR-Impfung verbürgt hätten und alles daran setzen würden, sich zu schützen.

Wie immer bei sehr seltenen Nebenwirkungen gebe es noch keine endgültige wissenschaftliche Belege, keinen "rauchenden Gewehrlauf", jedoch zeigen immer mehr klinische und wissenschaftliche Daten, "dass das Lebendvirus im MMR-Impfstoff bei einer Untergruppe anfälliger Kinder Schäden im Gehirn, Darm und Immunsystem verursachen kann." Es gebe ein starkes epidemiologisches Signal, dass einige Kinder durch die MMR-Impfung einem immunologischen Risiko ausgesetzt werden. Besonders gefährdet seien Kinder, deren Geschwister an einer Autoimmunerkrankung oder Diabetes leiden. "Es ist gut vorstellbar, dass das Immunsystem einer kleinen Minderheit einfach durch drei Lebendviren im MMR- Impfstoff und die ständig wachsenden Anzahl von Impfungen überfordert ist."

Fletcher weist darauf hin, dass es schon bei den ersten Hinweisen auf die Übertragbarkeit von BSE auf den Menschen und bei den ersten
20 bis 30 Verdachtsfällen zu Panik in der Bevölkerung kam, und Millionen von Kühen geschlachtet wurden. Im Falle der MMR aber investiere die Regierung nicht in weitere Forschung, sondern gebe Millionen aus für PR-Kampagnen zugunsten der Impfung. Die Behauptung, die zehnfache Zunahme von Autismus und verwandten Störungen in den letzten 15 Jahren beruhe allein auf der Veränderung der Diagnosekriterien, sei jedoch völlig abwegig.

DENABY parents and schools have been told Doncaster Council is powerless to stop a mobile telephone mast being built next to a popular play area in the village. Doncaster Council planning committee has approved an application by Hutchinson 3G UK Ltd for the siting of a 15m high telecommunication tower at Denaby and Cadeby Miners' Welfare, despite objections from villagers. Dozens of people who signed a petition fearing potential harm to schoolchildren from the mast were told their protests had been in vain at a meeting of the committee at Doncaster's Mansion House on Tuesday. Campaigners were told that planners' hands were tied as Government regulations meant masts under 15 metres did not require prior approval. The mast will be built on the site of an existing floodlight. Denaby resident Keith Drewett, who has collected more than 130 signatures opposing the mast, and Denaby councillor John Mills spoke out against the plans. Mr Drewett said: "I am very disappointed with the decision. I am concerned about the effect this mast could have on the health of local children and residents." He said there was evidence that prolonged exposure to phone mast transmissions within short distances could be dangerous. "We feel there was not enough time to respond to the application – two notices were put up, one on a lamppost and one in a local shop window. Dozens of people have said if they had have known about this they would have signed the petition. "Tickhill Square is a main thoroughfare for four schools, a day nursery, a youth centre and a medical centre. Only one school was notified of this application and the letter was sent as the school broke up for the Christmas holiday and required a response within 14 days," he said. He produced letters addressed to the committee from Balby Street, St Alban's and Fullerton House Schools whose pupils used the play area. Mr Drewett also quoted a resident who lived 100 yards from the mast who suffered from a condition which meant using a mobile phone caused her pain. She was 'extremely alarmed and afraid' of how the transmitter would affect her. Coun Mills said there was a 'genuine fear' in Denaby about the mast and residents felt they had not been given a fair chance to consider the proposal in depth. He asked if Hutchinson could have shared an existing transmitter already in use on Banbury Bridge which was well away from centres of population. A Hutchinson 3G spokesman said the company had looked at other sites which had been either too low or would not have had permission to use them. The mast was more than 100m from the nearest residential property and the mast would be five metres lower than the existing floodlight. The company had demonstrated an installation was required to provide 3G coverage to Denaby Main in line with its licence to provide 80 per cent coverage by 2007.

A CHURCH could be the first in Comet country to have a phone mast installed on its roof if planning permission is granted.

Holy Trinity Church in Stevenage has applied for a phone mast to be installed but nearby residents are concerned the church is willing to put people's health at risk for financial benefit.

The church could receive £5,000 a year for having the mast located in a plastic belfry at the opposite end of the roof to the original one.

Peter Craig has collected 63 names on a petition against the application.

Mr Craig, who lives close to the church, said: "Is it right that the church should benefit financially while putting the health of the local community at risk?

"The mast is a great concern as government research shows that doubts remain regarding the health effects of exposure to radiation from masts."

The Rev Geoff Tickner said after careful consideration it was decided that putting up a phone mast was an appropriate use of the church.

He said the money would "enable the church to continue to serve the community".

A private company, QS4, was selected by the Church of England to deal with applications for phone masts on church buildings in 2002.

Mr Tickner said he has only received four replies to a public consultation, two for and two against.

He told The Comet: "Our best advice is that they [phone masts] are safe otherwise the Archbishops Council would not allow phone masts on church buildings."

He is not worried about living so close to the mast but admitted that there are technical details surrounding mobile phone masts which he does not understand.

John Horsley, church project manager at QS4, said: "Network planners have identified a shortfall in coverage in Old Town Stevenage and being a conservation area it is a challenge to provide coverage without any visual impact."

He said the mast would give out signal strengths which are much weaker than those of television and radio transmitters.

AN ORGANISATION which has voiced support for anti-mobile phone mast campaigners across Widnes and Runcorn claims the industry has avoided questions on legislation which is set to go through parliament.

Planning Sanity, a partner organ-isation to Mast Sanity, claims the Mobile Phone Industry Trade Association and the Mast Operators Association (MOA) has refused to enter into a public debate on what is being hailed as the most significant telecom legislation ever to go before Parliament.

The MOA, which it claims had earlier indicated its willingness to discuss the bill's detail, has declined an invitation to take part in a public debate involving affected residents and MPs.

Mast Sanity alleges that the director of MOA, Mike Dolan, made the excuse that a public debate 'would not be helpful'.

Chris Maile, Planning Sanity director said: 'Just what is the mast industry afraid of? Are they so concerned that their industry's infrastructure concessions that the Government has granted to them, enabling them to walk over the rights of those affected by their installations often without the ability to challenge, that they cannot stand up and debate with the mast movement the bill's provisions?

'This refusal can only be seen as cowardice.'

Planning Sanity is challenging Mr Dolan to meet its representatives head on in a public forum for a debate about a planning regime which is said to give telecom developers more rights than any other commercial developer.

Planning Sanity and Halton campaigners hope that if the bill proves successful it will strip the mast industry of most of its planning 'privileges'.

It would force the industry to go through the same planning process as everyone else.

Residents claim the Government feels obliged to give companies the right to site masts wherever they please because they the government made billions of pounds from the sale of 3G licences to the industry.

SUBURBAN Stratford doesn’t clash with the law very often, but this week saw residents of the leafy suburbs come out in force to fight off contractors installing a telephone mast in the town cemetery.

Campaigners who fought to stop a mobile phone mast being erected in the Evesham Road cemetery held a 12-hour protest on Monday as work began to install it.

Picnic chairs and flasks of tea were the order of the day. This was middle England fighting for the peace and tranquillity of its dead. Those who lay in the cemetery should not be disturbed, and those who live near it fear the possible health effects of having the third generation mobile phone mast so close. Those were the messages of some 100 residents who turned up to register their opposition.

Protesters faced police officers at the cemetery gates as vans brought equipment in. Eight officers, two patrol cars and a police van arrived shortly before midday. One was heard to say: “I’ve made it to 74 without being arrested, and I don’t particularly want to get arrested now.”

CAMPAIGNERS against mobile phone masts have presented a 750-signature petition to Parliament.

Alan Eaton, the brains behind the action group Orange Squash, gave the petition to MPs David Curry and David Evennett last Friday.

The petition was signed by hundreds of worried parents in a bid to stop mobile phone chiefs erecting a mast near Bedonwell Primary School in Bedonwell Road, Belvedere.

Residents are calling on the Government to back the Telecommunications Masts (Planning Control) Bill, a private members Bill submitted by Mr Curry.

If his bill eventually becomes law, it will prevent masts from being placed in close proximity to schools and hospitals.

Today we learned that some U.S. Senators are pushing a plan aimed at slipping oil rigs into the Arctic National Wildlife Refuge through a back door. The deal would change the federal budget so that it counts on the income generated from drilling in the refuge – despite the fact that Congress has repeatedly voted against sinking oil wells there.

Most Americans don’t want oil rigs in the arctic,1 and the payback wouldn’t even amount to 1/20th of our oil demand.2 So why are some lawmakers so obsessed with letting oil companies into the wildlife refuge?

Here’s one potential answer: Senators on the budget committee have taken a total of $4 million in campaign contributions from the oil and gas industry. One of the senators pushing hardest for the drilling plan, Pete Domenici (R-NM),3 has collected more than anyone else on the committee.

The case of the fatal shooting by a state trooper that helped inspire the march from Selma in 1965 as well as the "Bloody Sunday" protest that preceded it, will be reopened next week by a special grand jury. "There is no question about who did the shooting," said District Attorney Michael Jackson. "The question is whether this was a murder or it was something else." Jackson reopened the case at the request of constituents who felt the full story had never been told.

In Newfane, Vermont, in a white-clapboard town hall circa 1832, voters gathered Tuesday to conduct their community's annual business and to call for the impeachment of President Bush. When President Bush arrived in New Delhi last week, India had the capacity to produce 6 to 10 nuclear weapons per year. When he departed after reaching a tentative nuclear deal with India, that South East Asian nation will potentially be able to produce nearly 50 nuclear weapons per year.

Before the new U.S.-India nuclear agreement is implemented, however, Congress will have to approve changes to existing legislation that would weaken several nonproliferation laws. This deal would undermine years of work by the U.S. to strengthen the nuclear Non-Proliferation Treaty (NPT), the international agreement endorsed by 188 nations that bans the export of nuclear technology to countries that don't agree to international inspections of their nuclear programs.

India has refused to sign the NPT and has conducted tests of a nuclear weapon as recently as 1998. Nonetheless, the Bush administration wants to provide India with nuclear technology and fuel. In exchange, India has agreed to international inspections for 14 of its 22 nuclear reactors. This proposal undermines the NPT by tacitly encouraging other countries to make bilateral nuclear agreements with non-NPT members in violation of a basic principle of that agreement.

The proposed U.S.-India agreement could also deteriorate relatively stable relations between India and Pakistan if the latter perceives this agreement to be an aggressive move. What would stop Pakistan from reaching a similar agreement with China? Furthermore, even while the U.S. is criticizing Iran (an NPT member) for developing its nuclear technology, the U.S. is simultaneously creating a double standard by offering India (a non-NPT member) similar nuclear technology. The U.S. loses a lot from this nuclear agreement with India and gains very little.

*Congress Can Block This Deal* The verbal nuclear cooperation agreement that President Bush negotiated with Indian Prime Minister Singh last week is far from a done deal. Congress will soon begin debating legislation to implement the U.S.-India nuclear agreement.

The impeachment campaign is in full swing

Just last week tens of thousands of people participated in the People’s Impeachment Lobby by sending letters to their Congressional Representatives.

Last Thursday, New York City’s historic Town Hall Theatre in Times Square filled up with people supporting impeachment. The event was sponsored by Harper’s magazine. Many of those in attendance took the ImpeachBush.org/VoteToImpeach.org petitions home with them promising to collect signatures in the coming weeks.

Radio personality Garrison Keillor has just released an article entitled "Impeach Bush." and actor Richard Dreyfuss called for impeachment, while speaking before the National Press Club in Washington.

San Francisco Supervisors Ask Lawmakers to Impeach Bush

San Francisco's supervisors jumped into national politics Tuesday, passing a resolution asking the city's Democratic congressional delegation to seek the impeachment of President Bush for failing to perform his duties by leading the country into war in Iraq, eroding civil liberties and engaging in other activities the board sees as transgressions.

The supervisors, in voting 7-3 for the resolution, made it likely that San Francisco again will become grist for radio and TV talk shows. The city has appeared in the national media spotlight recently for voters' passage in November of a nonbinding measure banning military recruiters from public high schools and for Supervisor Gerardo Sandoval's recent comment on a Fox News show that the United States doesn't need a military.

Supervisor Chris Daly, one of the most progressive members of the board, sponsored the resolution, which also calls for the impeachment of Vice President Dick Cheney. Daly said the measure is justified in light of the administration's case for and handling of the war in Iraq, the federal government's inadequate response to Hurricane Katrina and recent revelations about a domestic wiretapping program."I think the case is clear, and I think it's appropriate for us to weigh in," Daly said. >>

President Bush has proposed huge cuts in key programs that protect animals and habitat across the globe, including tropical forests. The president wants Congress to slash funding for the Global Environment Facility (GEF), a little known but extremely important international institution that supports conservation projects around the world. The GEF has helped prevent conflicts over scarce water resources in the Nile basin, expand the use of renewable energy in Mexico, and eliminate dangerous pesticides in Africa. The United States has repeatedly underpaid what it has pledged to the GEF. Now, the president wants to make even deeper cuts.

On the positive side, the president has requested level funding for international biodiversity conservation programs funded by the U.S. Agency for International Development.

OUTRAGED residents have been left seething amid claims they were not told about plans to build a 100ft mobile phone mast near their homes.

A giant mobile phone mast for Orange is being built on the boundary of Guilden Sutton and Littleton but Tarvin Road residents say Chester City Council failed to consult them about it.

Edward Courage, 50, of Tarvin Road, said: “Planning permission for a mast has been applied for a number of times in the past but the applications have been unsuccessful and have been rejected but this time it has been allowed to go through.”

He is furious because he believes the city council sneaked the consultation through last September without properly consulting the people along Tarvin Road.

He said: “The Guilden Sutton ward had a site meeting but omitted to ask us to it. The first we’ve heard about it is the idea we have to go to the High Court to make our views known.

“The city council has told us it’s our only recourse, that and the ombudsman.

“Unfortunately none of us know how to go about doing either of these things.

“I think all 50 people living along here have signed a letter to the council asking for the mast to be shrouded or moved.

“The only shrouding the mast has had is that it has been painted green.

“The reason we’re so annoyed is the only joy we have is the view to the north. We feel completely let down.”

Like many other residents along the road he feels the height of the mast is excessive.

Mr Courage said: “There must be at least 100 masts in Chester, there’s no need to build the mast so high.”

Disputes

Another Tarvin Road resident said: “Everyone along the road is affected by it and you can see it from the road.

“We want to get as many facts together about this as possible to make sure what we’re saying is right. Then we will be in a better position to act.”

Brian Hughes, development co-ordination manager, said: “I’m going out to a meeting with the residents on Thursday.

“But the planning board generally only notify people within a certain radius and the Tarvin road properties are not in the 200 metre radius of the transmitter.”

He also disputes the fact the council has acted unfairly in the way they have gone about accepting the mast.

He said: “No-one has a right to look over someone else’s land for a view. They’re not in a position to protect their view and people’s views are not something we can take into account in considering a planning application. I understand their point but you can’t do anything about it.”

The city council is already reviewing the process by which the permission was granted, which is standard practice when complaints are made after a planning board approval but Mr Hughes was confident the review would not find any fault in council procedures.

He said: “We realise this needs to be done as soon as possible so the residents know where they stand.

“They want a firm position from us so they know whether we feel we have made a mistake or not then they’re able to take the next step.

“I’m not sure I want to go into speculating about the possible outcomes.

“The ombudsman can’t change the decision but he can require the council to pay compensation if he feels their homes have been unduly affected by a planning decision. The other course of action is to take things to judicial review.”
