Chaos Computer Club veröffentlicht Vertragsentwurf zur Internetzensur

BKA-Sperrliste soll geheim bleiben

Der Chaos Computer Club (CCC) veröffentlicht den Vertragsentwurf [1], den das BKA mit den Internet-Service-Providern (ISPs) schließen möchte.

Die ursprünglich von Familienministerin von der Leyen vorgeschlagene Ausblendung bzw. Sperrung von Webseiten soll durch einen Vertrag zwischen dem Bundeskriminalamt (BKA) und den Internet-Service-Providern (ISPs) als Zugangsanbieter zum Internet durchgeführt werden. Der dem CCC zugespielte Vertrag, der den ISPs bereits unterschriftsreif zugestellt wurde, verpflichtet die ISPs, ihren Kunden den Zugang zu einer geheimen und somit nicht rechtsmittelfähigen Liste von Domains zu verwehren.

Der Vertragsentwurf verpflichtet die ISPs, die nur werktags vom BKA übermittelten Zensurlisten geheimzuhalten. Somit sieht sich der CCC in seinen Befürchtungen [2] bestätigt, dass Frau von der Leyen zusammen mit Innenminister Schäuble und dem BKA eine Vorzensur ohne gesetzliche Grundlage einzuführen versucht.

"Der hier vorliegende Versuch des Bundesinnenministers, eine ´freiwillige´ Vorzensur ohne gesetzliche Grundlage zu schaffen, ist ungeheuerlich. Flankiert durch die Bundesfamilienministerin von der Leyen wird hier das Thema Kinderpornographie instrumentalisiert, um eine Zensurautomatik für Internetseiten einzuführen. Mit dem vorliegenden Vertragsentwurf wird nicht nur deutlich, dass das Bundesinnenministerium offenbar überhaupt kein Interesse an einer Strafverfolgung gegen die Täter hat, sondern eine geheime Infrastruktur für das Zensieren von Internetseiten plant", sagte CCC-Sprecher Andy Müller-Maguhn.

Technisch soll die "Erschwerung des Zugangs" durch die Umsetzung der Sperrlisten des BKA durch die ISPs vollzogen werden. Die betroffenen Domains, bei denen das BKA festgestellt hat, dass diese kinderpornographische Schriften im Sinne von § 184b des Strafgesetzbuches (StGB) beinhalten oder den Zugang hierzu vermitteln, sollen innerhalb von sechs Stunden durch die ISPs gesperrt werden. Warum das BKA nicht sofort durch polizeiliche Ermittlungsarbeit gegen die auf der Zensurliste gelisteten Urheber derartiger Materialien vorgeht, bleibt völlig unklar. Der CCC sieht dadurch bestätigt [3], dass nicht die tatsächliche Bekämpfung der Kinderpornographie und der Schutz der Kinder, sondern die Schaffung einer Zensurinfrastruktur im Vordergrund stehen.

"Es wird deutlich, dass das Bundesinnenministerium mit dem Thema Kinderpornographie und der Flankierung durch Familienministerin von der Leyen offenbar einen Bereich herausgesucht wurde, mit dem am ehesten gesellschaftliche Akzeptanz für Sperrmaßnahmen erreicht werden kann. Wenn aber eine solche Infrastruktur erst einmal vorhanden ist, wird eine Ausweitung auf andere Themenbereiche – seien es sogenannte terroristische Propaganda oder Verstöße gegen Urheberrechtsbestimmungen – ein Leichtes sein", sagte CCC-Sprecher Andy Müller-Maguhn.

Die offensichtlich verfassungswidrige Planung soll dabei nicht das Gesetzgebungsverfahren durchlaufen, sondern durch zivilrechtliche Änderungen der Allgemeinen Geschäftsbedingungen (AGB) der ISPs durchgeführt werden. Diese Art der Umsetzung durch eine Änderung der AGB eröffnet immerhin frustrierten Kunden ein Sonderkündigungsrecht und somit den Wechsel zu einem zensurfreien ISP.

Die im Vertrag scheinbar datenschutzrechtlich unbedenklich gehaltene Regelung, dass die ISPs das BKA lediglich über die Anzahl der Zugriffe auf die jeweils gesperrten Seiten informieren sollen, nicht aber über Personen, die einen Zugriffsversuch durchgeführt haben, sind zudem im Kontext der Vorratsdatenspeicherung (VDS) längst unterminiert.

Rettungspaket für Rentnerinnen und Rentner

Der stellvertretende Parteivorsitzende Klaus Ernst schließt sich der Forderung von SoVD-Chef Adolf Bauer nach einer stärkeren Berücksichtigung von Rentnerinnen und Rentnern im Konjunkturpaket II an. Ernst forderte eine sofortige Rentenerhöhung von vier Prozent und eine Rücknahme des 0,9-Prozent-Beitrags zur Krankenversicherung. Er erklärt:

Die Regierung muss ein Rettungspaket für Rentnerinnen und Rentner schnüren. Mit einem Bündel von Sofortmaßnahmen könnten die Rentnereinkommen drastisch angehoben werden. Grundsätzlich müssen die Renten sofort um vier Prozent steigen. Der Sonderbeitrag von 0,9 Prozent zur Krankenversicherung muss wegfallen. Er benachteiligt Rentner besonders, weil sie gar kein Krankengeld beziehen können. DIE LINKE fordert darüber hinaus eine Mindestsicherung in der Rente. Niemand darf im Alter weniger als 800 Euro im Monat haben. Dafür müssten sofort mehr als zehn Milliarden in die Rente gesteckt werden. Das wäre gut angelegtes Geld. Die Konjunkturmaßnahmen der Regierung leiden an einer sozialen Schieflage. Sie nutzen vor allem den Banken und Unternehmen. Bei den Menschen kommt von den Milliarden fast nichts an. So wird nicht die Konjunktur angekurbelt sondern die Profitgier.

RESIDENTS at Belvedere Manor are calling foul over plans to build a mobile phone mast close to their homes.

Hundreds of people have so far signed a petition against the mast plan.

Proposals have been made to place a mast on the grass verge at the junction of the Kilmore Road with the Antrim Road.

Residents of Belvedere Manor have now started a petition against the plans.

The Obama administration keeps having to learn that bland centrism is not pragmatic, it’s not helpful in resolving a big crisis, and it certainly doesn’t buy you any love. Oddly, this week’s good news for the president—in Wednesday’s agreement on a stimulus package—and the bad news teach the same lesson. The bad news came in the almost uniformly negative early reviews of Treasury Secretary Tim Geithner’s bank rescue plan. It didn’t constitute change we can believe in. It was change nobody could understand. For all we know, the plan is, as was once said of Wagner’s music, better than it sounds. Who could be sure, given the vagueness of Geithner’s pronouncements? This is the cost of bland centrism: The plan seemed to be defined more by what it didn’t want to be than by what it actually was, inspired more by a concern with how things look than what actually works...
