Die deutsche Bundesregierung möchte weiterhin eine gemeinsame Verfassung für Europa durchsetzen. Während des deutschen EU-Ratsvorsitzes im kommenden Jahr möchte sie "dem Verfassungsprozess neue Impulse verleihen". Die Bundesregierung will aber einem Beschluss vom Dienstag zufolge offenbar weder eine Neuverhandlung des Vertragstextes noch eine Abstimmung über nur einen Teil des bestehenden Verfassungsentwurfs. Eine "Verfassung light" könne man sich nicht als Ergebnis der deutschen Ratspräsidentschaft vorstellen, hieß es in Regierungskreisen in Berlin. Vielmehr wurde das Ziel erneuert, bis 2009 zu einem Abschluss über die erste EU-Verfassung zu kommen - scheinbar in der bisherigen Version, die in Referenden in Frankreich und in den Niederlanden förmlich gescheitert ist.

The story which broke last week about a traveler risk scoring system called the Automated Targeting System, or "ATS," evokes an image of an Orwellian world in which the State compiles a secret dossier on every individual and sorts the population according to secret criteria, assigning each person a "risk score." The individual has no recourse to challenge his risk rating, and he has no way of correcting any false or incomplete information about him. In fact, he will never know what information is being used against him, or even the criteria on which he has been judged a risk to the State. It is a disturbing image, and the fact that the government has been conducting the ATS program in secret for four years has shocked many people. However, the ATS is hardly a surprise to those who have been keeping track of similar programs...

Hundreds of thousands of Iraqis who have fled their homeland are likely to seek refugee status in the United States, putting intense pressure on the Bush administration to re-examine a policy that authorizes only 500 Iraqis to be resettled here next year. 650,000 Iraqi dead given voice in Congress

The briefing was to discuss the October 2006 study Mortality after the 2003 invasion of Iraq: a cross-sectional cluster sample survey, which appeared in the British medical journal The Lancet. This study estimated that 655,000 more Iraqis had died (”excess deaths”) since the invasion than would have died if the prewar rate of death (mortality) had continued. It further estimated that about 600,000 of these had died from violence.

Grüne erwischen den Bundesrat beim Tricksen

Anlässlich der Antwort der Bundesregierung auf unsere Anfrage betreffend den Gesetzentwurf des Bundesrates zur Änderung des Betreuungsbehördengesetzes erklärt Jerzy Montag, rechtspolitischer Sprecher:

Mit unserer Anfrage zum Betreuungsbehördengesetz haben wir heute den Bundesrat beim Tricksen erwischt.

Unter dem unverfänglich klingenden Namen "Gesetz zur Änderung des Betreuungsbehördengesetzes" wollte der Bundesrat den Behörden das Recht zusprechen, auch ohne Einwilligung des Betroffenen dessen persönliches Umfeld auszuforschen.

Der Bundesrat begründete die Notwendigkeit der Regelung mit Forderungen der Praxis, denen sich die Bundesregierung bisher verschlossen hätte. Wörtlich heißt es im Gesetzentwurf: " Die Betreuungsbehörden in der Bundesarbeitsgemeinschaft der überörtlichen Sozialhilfeträger haben dringenden Handlungsbedarf gesehen und das Bundesministerium der Justiz aufgefordert, eine Initiative zu einer einheitlichen Klarstellung der Befugnisse der Betreuungsbehörden zu ergreifen. Diese ist bisher unterblieben".

Doch die Antwort der Bundesregierung zeigt: Es besteht gar kein von den Betreuungsbehörden eingeklagter Handlungsbedarf.

Auf unsere Anfrage hin teilt die Bundesregierung vielmehr mit:

1. Die Bundesarbeitsgemeinschaft der überörtlichen Sozialhilfeträger hat sich kein einziges Mal an das Bundesministerium der Justiz wegen des angesprochenen Problems gewandt.

2. Eine Nachfrage der Bundesregierung bei der Bundesarbeitsgemeinschaft hat ergeben, dass diese keine Erkenntnisse über angeblichen von Betreuungsbehörden angemeldeten Handlungsbedarf in diese Sache hat.

3. Dem Bundesministerium der Justiz liegt in dieser Sache lediglich ein einziges Schreiben der Landesbetreuungsstelle der Freien und Hansestadt Hamburg aus dem Jahr 2004 vor, die von Meinungsverschiedenheiten mit dem Landesdatenschutzbeauftragten berichtet.

Damit wird deutlich: Der Gesetzentwurf des Bundesrates will die Rechtsposition betreuungsbedürftiger Menschen schwächen, nur um den Behörden lästige Rückfragen beim Vormundschaftsgericht zu ersparen. Für uns bleibt es aber dabei: In die Grundrechte besonders hilfloser und betreuungsbedürftiger Menschen dürfen Behörden nur mit einer gerichtlichen Zustimmung eingreifen.

Zum Internationalen Tag der Menschenrechte am 10. Dezember erklärt Helmut Scholz, Mitglied des Parteivorstandes der Linkspartei.PDS und Politischer Koordinator des Sekretariats der Europäischen Linkspartei:

International wie national ist der 10. Dezember kein Anlass zum Feiern. Die Situation in Nahost, im Irak, in Afghanistan oder im Kongo zeigt uns, dass Krieg und Unterentwicklung als die größten Menschenrechtsverletzungen nach wie vor nicht geächtet sind. Mit Blick auf die deutsche EU-Ratspräsidentschaft fordern wir die Bundesregierung auf, sich dafür stark zu machen, dass die EU-Grundrechtecharta endlich politisch einklagbar und vertraglich gewährleistet wird. Die Linkspartei.PDS fordert die Einheit von sozialen Menschenrechten und individuellen Freiheitsrechten. Nur so kann die gleichberechtigte demokratische Teilhabe aller gesichert werden. Niemand darf sich da zurücklehnen. Sicherung und Ausbau von Menschenrechten sind eine ständige Aufgabe, die das Mittun jedes einzelnen erfordert. Die vorrangige Aufgabe der Linken ist es daher, Menschen zu ermuntern und zu unterstützen, sich für ihre Menschenrechte einzusetzen. In Deutschland nimmt das klare Ungleichgewicht zugunsten der Gewährung individueller Freiheitsrechte und zum Nachteil sozialer Rechte zu. Während sich die Ostdeutschen noch an den ausgeprägten Ausbau der sozialen Rechte in der DDR zum Nachteil der Bürgerrechte erinnern, werden in der heutigen Bundespolitik soziale Rechte weiter ausgeblendet. Die bundesdeutsche Sozialpolitik seit 1989 macht dies deutlich. Mit dem fortschreitenden Abbau des Sozialstaates wurden und werden Menschen benachteiligt: Einer zunächst wirtschaftlichen Ausgrenzung folgt die sozial-, bildungs- und gesundheitspolitische Marginalisierung, die Möglichkeit, sich an der gesellschaftlichen Entwicklung aktiv zu beteiligen, wird verwehrt. Wenn jedes 8. Kind in Deutschland heute in Armut lebt, ist das ein dringender Grund, am internationalen Tag der Menschenrechte vor der eigenen Haustür zu kehren, bevor über die Missachtung von Menschenrechten in anderen Ländern lamentiert wird.

80 Prozent der Menschen in Deutschland wollen nach einer Umfrage über die Umstände ihres Todes selbst bestimmen. Jeder fünfte der über 65-Jährigen hat bereits eine Patientenverfügung. Doch eine solche Verfügung, in der niedergelegt wird, welche Behandlung man sich wünscht – oder nicht mehr wünscht –, hat in Deutschland keine bindende Wirkung. Das wollen Union und SPD jetzt ändern. Vorerst allerdings auf getrennten Wegen. In beiden Bundestagsfraktionen liegen Entwürfe zur gesetzlichen Regelung der Patientenverfügung vor. Die Initiativen unterscheiden sich in zentralen Punkten.

Der Entwurf aus den Reihen der SPD- Rechtspolitiker unter Federführung von Joachim Stünker ist der weitergehende. Nach dessen Vorschlag soll eine schriftlich fixierte Patientenverfügung generell bindend sein. Und zwar „unabhängig von Art und Stadium der Erkrankung“, wie es in dem Entwurf heißt. Zutreffen müsste das dann beispielsweise auch auf jemanden, der nach einem Unfall schwerstgeschädigt an Apparaten hängt und unabsehbar als Pflegefall am Leben erhalten würde. Nur bei Zweifeln über den mutmaßlichen Patientenwillen entschiede das Vormundschaftsgericht. „Das Selbstbestimmungsrecht der Patienten hat Vorrang“, fasst Joachim Stünker seinen Entwurf zusammen.

Auch der Rechtspolitiker der Union, Wolfgang Bosbach (CDU), strebt eine „grundsätzlich bindende“ Patientenverfügung an. Allerdings macht Bosbach eine entscheidende Einschränkung: Die Verfassung verpflichte den Gesetzgeber nicht nur zur Achtung des Selbstbestimmungsrechts des Einzelnen, sondern auch zum Lebensschutz, wie es in seiner Vorlage für die Unionsfraktion heißt, anhand der jetzt eine Arbeitsgruppe einen Gesetzestext formulieren soll. Eine lebenserhaltende medizinische Maßnahme dürfe deshalb nur bei ganz bestimmten Fällen abgebrochen werden: „Bei irreversiblen Grundleiden, die trotz medizinischer Heilbehandlung einen tödlichen Verlauf genommen haben.“ Auf den unfallgeschädigten Pflegefall träfe das nicht zwingend zu. Ebenso wenig erfasst wäre ein Wunsch nach Unterlassen einer Wiederbelebung nach einem Herzstillstand ohne vorherige tödliche Krankheit.

Eine Ausnahme aber schlägt auch Bosbach vor: Bei Menschen, die über lange Zeit ohne Bewusstsein sind, etwa in einem stabilen Wachkoma verharren, und „mit an Sicherheit grenzender Wahrscheinlichkeit“ das Bewusstsein niemals wiedererlangen werden. Auch in diesen Fällen solle bei vorliegender entsprechender Patientenverfügung eine lebenserhaltende Maßnahme abgesetzt werden.

Angesichts der grundlegenden Differenzen wird es einen Gesetzentwurf der Koalition nicht geben. Allerdings haben sich die Rechtspolitiker auch verständigt, dass es keine Fraktionsanträge geben wird. Zu heikel die Materie, zu individuell das ethische Empfinden. Deshalb wollen Union und SPD zu Beginn des Jahres ihre beiden Vorschläge als Gruppenanträge auf den Weg bringen. Die Mehrheit soll im Plenum des Bundestages über alle Parteigrenzen hinweg gefunden werden. Im ersten Quartal 2007 dürften die Anträge ins parlamentarische Verfahren gehen.

Außerhalb des Parlaments wird die Patientenverfügung derzeit sehr kontrovers diskutiert. Die „Aktion Gemeinsinn“ unter Schirmherrschaft von Bundespräsident Horst Köhler steht mit einer Kampagne zur Regelung der Patientenverfügung eher für die Selbstbestimmungsposition. Die hochrangig besetzte Bürgeraktion warnt vor Bestrebungen, „die Verpflichtung zur Befolgung des Patientenwillens aufzuweichen“. Auf der anderen Seite lehnt sich die katholische Kirche vehement gegen eine bindende Auslegung der Verfügung, auch auf nicht tödliche Krankheitsverläufe, auf. An einer einvernehmlichen Regelung dieser schwierigen Frage hatten sich Justizministerin Brigitte Zypries (SPD) und die Enquetekommission des Bundestages in der letzten Legislaturperiode versucht – ohne Erfolg.

Council earns a fortune from phone masts

BIRMINGHAM City Council is raking in more than half a million pounds a year in rent from controversial mobile phone masts.

The figure, the largest declared by any local authority in the country, is generated by 101 masts on council-owned buildings and land.

The city's total of £590,000 dwarfs its nearest rival Leeds, which receives £410,000.

The news will incense campaigners who believe that radiation from the masts causes cancer.

Birmingham had a year-long moratorium on new masts which was lifted in 2005.

But Birmingham still picks up more than Sandwell (£119,750), Wolverhampton (£112,425), Coventry (£44,429) and Dudley (£98,300) put together. Deputy Leader Coun Paul Tilsley said: "A figure like £590,000 for telephone masts might seem large, but many of those will be on schools who make their own management decisions and keep the income.

"Birmingham is also the largest authority in the UK by far and owns more property, so you would expect the figure to be proportionately higher."

In the past 12 months the total for Birmingham has fallen from 134 in 2004 following the moratorium, widespread health fears and a council inquiry into the issue.

Not every council is willing to state its income.

Manchester, for example, won't say how much it gets from the mobile phone companies, and neither will Solihull or Walsall.

Some major local authorities take much less in mast rental than Birmingham - Liverpool gets just £27,000.
