Darmstadt – Nach einer heutigen Entscheidung des hessischen Landessozialgerichts reichen die Hartz IV-Regelsätze nicht aus, um das soziokulturelle Existenzminimum der Arbeitslosen zu sichern. Damit die entsprechenden Passagen des Sozialgesetzbuchs II dem Bundesverfassungsgericht vorgelegt. Die pauschalen Sätze, die der Gesetzgeber für bedürftige Arbeitslose und ihre Kinder festgesetzt hat, sind nach Ansicht der Darmstädter Richter zu niedrig und verstoßen gegen die Menschenwürde der Arbeitslosen, gegen den verfassungsrechtlichen Gleichbehandlungsgrundsatz, gegen das Schutzgebot für Ehe und Familie sowie gegen das Rechts- und Sozialstaatsprinzip.

»Das Bundesverfassungsgericht fordert einen Schutz des Existenzminimums ohne wenn und aber«, sagte der Vorsitzende Richter Jürgen Borchert bei Bekanntgabe des Beschlusses. Doch der Gesetzgeber habe die Regelsätze so begrenzt, dass allenfalls das »nackte Überleben« gewährleistet sei.

Anlass für das Verfahren war die Klage einer Familie aus Eschwege. - Vater, Mutter und eine 14 Jahre alte Tochter. Die Arbeitsagentur Werra-Meisner hatte ihnen im Jahr 2005 einen monatlichen Betrag von knapp 830 Euro zugesprochen, je 311 Euro für die Eltern und 207 Euro für die Tochter. Hinzu kamen Miete und Heizkosten. Die Summe entsprach zwar den gesetzlichen Vorgaben, aber die Familie K. sah ihr Existenzminimum nicht gedeckt und forderte nachträglich eine monatliche Aufstockung um 355 Euro. Vor allem für die Tochter würde das Geld hinten und vorne nicht reichen. Das Kind könne sich kaum Hefte, Schuhe oder Klassenfahrten leisten.

Bislang hatten schon mehrere Arbeitslose haben erfolglos versucht, die Regelsätze des Sozialgesetzbuchs II gerichtlich auszuhebeln. Das Bundessozialgericht hatte die Hartz IV-Armut 2006 gebilligt, ein Urteil über die Summe für Kinder steht Mitte November an.

Familie K. hatte ihren Bedarf genau beziffert und das Gericht stützte seine Entscheidung auch auf die Aussage mehrerer Gutachter. In der mehr als sechs Stunden dauernden Verhandlung wurden die Berechnungsmethoden des Gesetzgebers kritisierten. Nachdem vier Gutachten zur Bedarfsbemessung eingeholt worden waren, beanstandeten die Darmstädter Richter, dass der besondere Bedarf von Familien mit Kindern durch die Regelleistungen nicht berücksichtigt werde. Für die Begrenzung der Leistung für Kinder auf 60 Prozent des Regelsatzes eines Erwachsenen fehle es an einer hinreichenden Begründung. Nicht ersichtlich sei auch, weshalb 14- jährige Kinder trotz höheren Bedarfs die gleiche Summe erhielten wie Neugeborene. Das Bundesverfassungsgericht habe bereits 1998 bei der Prüfung der Steuerfreibeträge den damals geltenden Regelsatz für Kinder beanstandet, weil dieser den außerschulischen Bildungsbedarf nicht berücksichtige. Diese höchstrichterliche Entscheidung sei bei der Hartz-IV-Gesetzgebung nicht beachtet worden, kritisierte das Landessozialgericht. Die Regelsätze seien weder mit der Menschenwürde, noch mit dem Gleichheitsgebot und dem sozialen Rechtsstaat vereinbar.

Beim Bundesverfassungsgericht wird nun die Frage anstehen, wie viel Gestaltungsspielraum der Gesetzgeber hat, wenn es um Hilfe für Bedürftige geht. In welchem Umfang können Gerichte statistische Methoden kontrollieren oder verwerfen? Der Vertreter der Bundesregierung kritisierte, die Sozialgerichte hätten schon »viel Kreativität darin bewiesen, Gesetze verfassungskonform auszulegen und sich als Bedarfslückenschließer zu betätigen«. Was volkswirtschaftlich wünschenswert sei, sei juristisch nicht immer zwingend. (Az. L 6 AS 336/07).

Nach hessischem Hartz IV-Urteil – Ansprüche sichern

Bonn – Das hessische Landessozialgericht hatte am Donnerstag (29.Oktober) verfassungsrechtliche Bedenken bei den Regelleistungen bei Hartz IV geäußert und deshalb in mündlicher Verhandlung beschlossen, das Verfahren an das Bundesverfassungsgericht abzugeben. Ebenfalls ist seit dem 30.Juli eine Verfassungsbeschwerde einer Hartz IV-Bezieherin aus dem Neckar-Kreis anhängig. Unter dem Aktenzeichen 1 BvR 1523/08 wurde der Frau durch das höchste Gericht Prozesskostenhilfe gewährt und gleichzeitig der Bundestag, Bundesregierung alle Bundesländer und zahlreiche Bundesbehörden und Verbände mit einer Stellungnahme bis Ende November beauftragt. Deshalb rät das Erwerbslosen Forum Deutschland, dass Betroffene sich unbedingt noch vor einer Entscheidung durch das Bundesverfassungsgericht ihre eventuellen Ansprüche für die Vergangenheit sichern sollen. Normalerweise müssen Behörden ihre Entscheidungen für die Vergangenheit zurück nehmen und Geldleistungen bis zu vier Jahre für die Vergangenheit zurück zahlen. Dennoch gibt es bei höchstrichterlichen Entscheidungen eine Sonderregelung, wonach Behörden Geldleistungen für die Vergangenheit nicht berücksichtigen müssen, wenn nicht vorher sog. Überprüfungsanträge oder Widersprüche gestellt wurden, die gleichzeitig den Antrag auf Aussetzung des Verfahren bis zu einer Entscheidung durch das Bundesverfassungsgericht beinhalten. (§ 40 SGB II i.V.m. § 330 SGB III).

Das Erwerbslosen Forum Deutschland stellt auf seinen Websiten sogenannte Überprüfungsanträge [1] und Widersprüche [2] zur Verfügung und weist darauf hin, dass für Ansprüche aus dem Jahr 2005 bis zum Ende des Jahres diese Überprüfungsanträge bei den Hartz IV-Behörden eingereicht werden müssen, da sonst die Ansprüche für das Jahr 2005, wegen der Vier-Jahresfrist, nicht mehr berücksichtigt werden. Wichtig ist, dass für rechtskräftige Bescheide, wo die Widerspruchsfrist abgelaufen ist oder Klagen durch die Sozialgerichte abgewiesen wurden, Überprüfungsanträge gestellt werden. Für zukünftige Bescheide muss Widerspruch eingelegt werden. Allen Anträgen liegt gleichzeitig der Antrag zu Grunde, dass im Fall der Regelleistungen die Behörde das Verfahren bis zu einer Entscheidung des Bundesverfassungsgerichts aussetzt.

Das Erwerbslosen Forum Deutschland weist darauf hin, dass damit zu rechnen sei, dass Behörden den Anträgen nicht folgen würden. Auch für diesen Fall hält das Erwerbslosen Forum Deutschland ein Muster für eine Klage [3] beim Sozialgericht bereit. Dabei ist zu beachten, dass zuerst Widerspruch gegen die Ablehnung des Überprüfungsantrags eingereicht werden muss. Nur wenn dem Widerspruch nicht abgeholfen wurde, kann Klage eingereicht werden, die für Hartz IV-Bezieher kostenlos ist.

Just over the horizon lies an alternate universe in which John McCain is locked in a tense nail-biter of a presidential race with Barack Obama, one in which the polls gyrate daily and ‘too close to call’ describes most of the contested political landscape. To create this what-if Republican fantasy, only one thing needs to be changed — and that mystery element has nothing to do with a mythical Barack Obama scandal or an inexplicable surge in George W. Large financial institutions, meanwhile, are doing much better, as the government continues to funnel billions to prop up their business. We know that homeowner assistance is piddling because of some worrisome data. Each day from July through September, more than 2,700 Americans lost their homes to foreclosure — up from 1,200 a day one year ago, according to Mortgage Bankers Association figures quoted by The Associated Press. At the end of June, more than 4 million homeowners with a mortgage were at least one month behind on their payments, and 500,000 had entered the foreclosure process, the association said...

GM is Not the Way to Sustainability

Conventional agriculture is not the answer, neither is GM

“In agriculture, the starting point, I think, has to be the recognition that the commercial industrial technologies that are used in agriculture today to feed the world are technologies that are not inherently sustainable and they have not worked well to promote either self-sufficiency or food security in developing countries.” Most people would be surprised to learn that these are the words of Robert Shapiro, then the CEO of Monsanto [1]:

And earlier [2]: “Loss of topsoil, salinity of soil as a result of irrigation and ultimate reliance on petrochemicals [which are] obviously not renewable. That clearly isn’t sustainable.”

This is the sort of statements you’d expect to come from a campaigning group rather than a big corporation. It’s a solid condemnation of the Green Revolution and a warning that the current attempt to extend it to Africa is misguided. Of course Shapiro was pushing what he saw as the alternative to industrial agriculture, namely genetically modified organisms (GMOs) for crops and livestock.

In fact, the evidence shows that the answer lies neither in conventional industrial agriculture nor in GMOs, but in organic agriculture. The 400 scientists who contributed to the recent report of the International Assessment of Agricultural Science and Technology for Development (IAASTD) certainly did not see GM as the answer to the food problem. On the contrary, they concluded it could have at most a relatively minor role [3, 4] (“GM-Free Organic Agriculture to Feed the World”, SiS 38).

The truth about genetic engineering is that it has consistently failed to deliver. It has not increased yields [5]: for example, researchers at the Universities of Kansas in the United States found that the yields of GM soya were about 6 per cent lower than those of their nearest conventional relatives [6], confirming results obtained since 2002 [7] (GM Crops Failed, SiS 13/14). It has not decreased the amount of herbicides and pesticides used. Since Roundup Ready crops have been widely grown in the USA, glyphosate application on major crops has gone up by a factor of 15 [8]. That has not been merely a matter of farmers switching to Roundup (Monsanto’s proprietary formulation of glyphosate); the application of other herbicides has also gone up. And it has not increased the profits of farmers: for example, a study has shown that farmers in the American state of Georgia who grew Bt cotton did not make more money than those who did not [9, 10] (Transgenic Cotton Offers No Advantage, SiS 38) and the mass suicides of cotton growers in India are all too well known (see GM is Dangerous and Futile [11], SiS 40).

The only group that have gained from GM are the biotech companies.

The supporters of GM continue to make extravagant claims for what it can accomplish, and you can easily be taken in if you do not look carefully at the evidence. For example, in the abstract of a recent paper in Science [12] the authors write: “Our data suggest that Bt cotton not only controls H. armigera on transgenic cotton designed to resist this pest but also may reduce its presence on other host crops and may decrease the need for insecticide sprays in general.”

The abstract is all you can read for free on the web, and it is what most commentators are likely to quote, especially if they are supporters of GM. In the full paper, however, the authors report that mirids, podsucking bugs that used to be controlled by spraying and by competition with the bollworm, have now become key pests of cotton in China. They conclude their paper with the statement: “Therefore, despite its value, Bt cotton should be considered only one component in the overall management of insect pests in the diversified cropping systems common throughout China.” That’s not at all what you would infer from the abstract.

Convenient for the party that does not hold the White House, which can create an agenda out of simple opposition. And convenient for voters, who can understand politics through the actions of a discrete player and offload their dissatisfaction onto the failures of a hapless individual. Army: Stop-losses likely to continue

The Army’s use of involuntary extensions of combat duty will likely continue through 2009 despite pledges earlier this year by top military officials to reduce reliance on the policy known as stop loss. In September, 12,204 soldiers were affected by stop loss, a policy that forces them to remain in the Army after their service commitment has expired. The same number likely will be affected each month through 2009, Army Lt. Col. Mike Moose said Thursday. Stop loss strains troops and their families, Defense Secretary Robert Gates and Adm. An open letter to the Eureka City Council

Dear Mayor, and City Council Members

The real injustice of the cell tower deal between Verizon and the Apostolic Church, on Harris and D. St., came to light to us while watching the city council meeting on public access television a couple weeks ago. I was aghast at the tepid response that most council members had toward residents' concerns and disappointed at their rush to approve this project. Even though we live a half a block from, and in plain view of, the 60 foot cell tower "to be", we were never notified by the city during the permitting process. Even more disheartening: it was our neighbor, who we are friendly with, who brokered the deal with Verizon behind our backs.

Something smells fishy in Eureka, and it's not from the high tide.

A glance at a cell tower locator map of Eureka on the Internet will reveal seven towers surrounding the city, most in commercial/industrial zones. This cell tower would be the first one in the center of town in a primarily residential neighborhood. I think this precedent is significant and warrants more attention than a few mailed notices to residents within a 300 foot radius of the proposed site. This past week, we walked around our neighborhood and talked to people about the project. Most people never received notice of the cell tower and were outraged that they were left out of the dialog.

What kind of city do we live in where hard working, tax paying citizens, are denied a real voice in decisions that will directly affect our lives?

Stop the permitting process.

This injustice must be undone now.
