Kritik an Anti-Terror-Datei: Hessische Regelung zur Rasterfahndung soll verfassungswidrig sein

Nach Auffassung des hessischen Datenschutzbeauftragten Professor Michael Ronellenfitsch ist die hessische Regelung zur Rasterfahndung nicht verfassungskonform. Er verweist hierbei auf die Überprüfung der nordrhein-westfälischen Regelung zur Rasterfahndung durch das Bundesverfassungsgericht. Die Kernaussage des Bundesverfassungsgerichts heißt laut Ronellenfitsch: "Ein solcher Eingriff in das Recht auf informationelle Selbstbestimmung ist nur dann angemessen, wenn der Eingriff vor der Schwelle einer hinreichend konkreten Gefahr für bedrohte hochrangige Verfassungsgüter abhängig gemacht wird." Im Vorfeld einer konkreten Gefahr scheide die Rasterfahndung aus. Der Hessische Datenschutzbeauftragte betont, dass aufgrund dieser Entscheidung die hessische Regelung zur Rasterfahndung geändert werden müsse, "da sie gerade als Vorfeldbefugnis ausgestattet ist". Professor Ronellenfitsch empfiehlt ausdrücklich, den Gesetzentwurf der FDP-Fraktion zur Rasterfahndung anzunehmen, da er die Vor gaben des Bundesverfassungsgerichts berücksichtige. Ronellenfitsch hält außerdem auch die im Dezember beschlossene Gesetz zur Errichtung gemeinsamer Dateien von Polizeibehörden und Nachrichtendiensten des Bundes und der Länder - Grundlage für die so genannte Anti-Terror-Datei - für problematisch.

Arbeitsagenturen (ARGEN) dürfen die Pflichten von Hartz-IV Empfänger/innen nicht einseitig festlegen und bei Verstößen die Leistungen kürzen. Das hessische Landessozialgericht in Darmstadt gab einer 24jährigen Frau aus Offenbach recht. Das geht aus einem Urteil (AZ: L 7 AS 288/06 ER), dass am Mittwoch veröffentlicht wurde, hervor. Das Gericht urteilte eindeutig: "Für Leistungskürzungen ist eine gesetzliche Grundlage erforderlich."

Worthing fights three mobile masts

MOBILE phone mast anger is brewing across Worthing, with three plans in the pipeline.

Findon Valley Residents' Association is starting its campaign against T-Mobile's plans to install a 36ft high mast at the junction of Findon Road and Cissbury Avenue.

People living near Worthing Football Club's ground in Woodside Road have to start their protests again, as Hutchison wants to upgrade its 44ft high 2G mast to a 56ft 3G monster.

This comes two weeks after a controversial T-Mobile scheme was approved for the ground.

Campaigners are still fighting a 33ft mast in St Andrew's Road, West Tarring, again from T-Mobile.

Mietobergrenzen für Hartz-IV Singles bedeuten oft Obdachlosigkeit

Mietobergrenzen bei Hartz IV, immer wieder heftig diskutiert und Bestandteil unzähliger Klagen in bundesdeutschen Sozialgerichten. Dabei könnte es so einfach sein. Städte und Kommunen müssen verpflichtet werden, ihre Mietobergrenzen detailliert und für Jedermann zugänglich zu veröffentlichen. Diejenigen, die dieser Verpflichtung nicht nachkommen, sollten alle Kosten der Unterkunft - ungeachtet der Angemessenheit - in voller Höhe auferlegt bekommen. Zudem müssen sich die Mietobergrenzen an dem verfügbaren Wohnraum und der Wohngeldtabelle messen lassen.

Dazu bedarf es aber der Veränderungen in den §§ 22 und 27 des SGB II und auch den Mut, diese endlich zu spezifizieren.

Mietobergrenzen sind gerade für Singles im SGB II ein potentieller Stolperstein in die Obdachlosigkeit. Die von den Städten und Kommunen festgesetzten Obergrenzen, aber auch deren willkürliche Senkungen führen dazu, dass gerade immer mehr Singles schwerwiegende Probleme bei der Wohnungssuche haben. Im sozialen aber auch freien Wohnungsbau wurden Wohnräume im Bereich von 45 m² über Jahre hinweg vernachlässigt.

Für Leistungsempfänger sind Mietobergrenzen nur in einem persönlichen Gespräch mit dem Sachbearbeiter zu erfahren.

Dies muss und sollte sich ändern!

Willkürliche Angemessenheitsrichtlinien gerade bei KDU (Kosten der Unterkunft) dürfen keine Einzelfallentscheidungen mehr bleiben. Wenn von politischer Seite immer wieder steigende Mehrausgaben im Bereich KDU zu lesen sind, so muss endlich auch Klarheit bestehen, um welche Kosten es sich detailliert handelt.

Auch Vermieter sind oft im unklaren, ob die von ihnen geforderten Mieten überhaupt von Leistungsempfängern genehmigt werden. Wer zuerst eine richterliche Entscheidung vor der Anmietung für eine angemessene KDU abwarten muss, der wird mit Sicherheit den Wohnraum niemals anmieten können, der zeitlich zur Diskussion stand, weil kein Vermieter seinen Wohnraum ungenutzt stehen lassen kann. Auch die Anmietung und Entrichtung der Differenz zur willkürlich genehmigten KDU, ist für Singles unmöglich.

Hier bleibt oftmals gerade in Notsituationen nur die Obdachlosigkeit und ihre Folgen. Selbst Wohnraum in städtischen Unterkünften ist nur selten verfügbar und wenn, dann nur in einen Zustand, der als menschenunwürdig betrachtet werden kann ( Mehrbettzimmer - Ungeziefer - etc. ).

Nur wenn endlich, sowohl von Seiten der Gesetzgebung und der Städten und Kommunen, klare Richtlinien vorliegen, könnten Sozialgerichte entlastet und Menschen geholfen werden.

Während in anderen EU Nationen ein Recht auf Wohnraum [**1] besteht, scheint in Deutschland gerade für Hartz-IV Singles nur ein Recht auf Obdachlosigkeit zu bestehen.

Surprise over phone mast victory

Families fighting plans for a mobile phone mast won an unexpected victory when councillors went against the recommendation of officers to reject the plans.

More than 80 people wrote to South Norfolk Council to object to plans for an 11.7 metre T-Mobile mast on land opposite the Crown pub in Norwich Road, Costessey.

Families living close to the proposed mast were concerned about the visual impact such a large structure would have in the area, while there were also fears about the possible heath effects on those living closest to the mast and on pupils at nearby Costessey Infant School.

But despite the strength of feeling against the mast planning officers at South Norfolk Council had made recommendations to the planning committee that it be approved when they met yesterday. However, councillors decided to reject the proposal because it would have been an eyesore - to the delight of campaigners, including South Norfolk councillor Tim East.

Mr East said: “I'm absolutely delighted that the planning committee unanimously decided to reject T-Mobile's application for a phone mast at Norwich Road on the grounds that they thought it was detrimental to the visual amenities of the area.”

Pauline Wilkinson, who has lived on Norwich Road, Costessey, with her husband John for more than 30 years, said she was surprised the mast had ever been recommended for approval given all the opposition to it. “It's a very busy area close to a number of shops, with cars, a pedestrian crossing and all the associated furniture, two large trees - I just couldn't see how sticking something else there was going to improve the area. I don't really see that there's a need for a mast there.”

Mrs Wilkinson said she had been concerned about the possible health effects on people living in the area, particularly the children who went to the school on Beaumont Road.

As the Evening News reported earlier this month, the small strip of grass where the mast was to be sited had been earmarked by parish councillors as a natural spot for a village sign and flower beds to create an attractive centre for New Costessey. The Evening News has campaigned against the installation of mobile phone masts near homes and schools until it is proved they are safe through our Put Masts on Hold campaign.

Application for phone mast

A MOBILE phone giant has lodged a planning request to erect a mast in the grounds of a cricket club.

T-Mobile wants to house the telecommunications mast in the form of a flag pole at Hartlepool Cricket Club, in Park Drive.

And, after having consultations with members of the West Park club, the phone giant has finally lodged a planning application to Hartlepool Borough Council.

However, there is no date as yet for when the issue will be discussed by the planning committee.

A council spokesman said: "The application has been submitted but there is no date for when it will be discussed as yet."

Last year, the Mail reported how the club was to receive a cash payment from T-Mobile for housing the mast, which would be used to buy an all-weather pitch.

And the club had no objections to the proposal as long as no danger to health could be proved.

However, there are objectors to the plan, including former councillor Jim Allan.

He is promoting a leaflet that will be sent to Park ward residents citing reasons why they should object to it.

The reasons include:

- It would be an unwelcome intrusion to the historic Park conservation area;
- The value of houses around the cricket club would be affected;
- Radiation from the mast could be detrimental to health and studies show sleeplessness, fatigue, irritability and sometimes cancer clusters;
- It would cause people to worry about their health;
- Radiation from the mast could affect the health of wildlife;
- French scientists recommend that masts are not erected closer than 900ft to areas where people live, work or play.

The Mail has previously reported concerns by Councillor Pauline Laffey, Conservative representative for the Park ward.

She said: "We have a park nearby and hundreds of homes, and I just don't think it's safe."

But Bill Shurmer, chairman of Hartlepool Cricket Club, said members believed the mast would be discreet and had allowed T-Mobile to proceed with a planning application.

He said: "We will do nothing that the experts consider a danger to health. "Indeed, any decision may be out of our hands, subject to the result of the planning application."

A T-Mobile spokesman said its interest was "due to the demand of services".

I don’t recall any of the others offering apologies. So now, Sen. Hillary Clinton is being warned by some of her supporters that she may endanger her front-runner status if she refuses to make some outright apology for having voted along with 76 other senators in 2002 to empower the president to use force in Iraq. A simple ‘I was conned and I’m sorry it happened’ might have done it. But the evolution of her position is like a study in self-torture...

Hört sich an wie ein Arbeitgeberverband - doch es sind die Positionen einer angeblichen Arbeitnehmervertretung. Viele Experten halten die Christlichen Gewerkschaften deshalb für eine Mogelpackung. Deren Funktionäre sitzen mit den Unternehmensbossen am Verhandlungstisch und nicken in den meisten Fällen Tarifverträge ab, die die Arbeitsbedingungen der Beschäftigten deutlich verschlechtern. Dabei hat diese selbsternannte Gewerkschaft kaum Mitglieder. Offiziell werden insgesamt 300.000 Christliche Gewerkschafter angegeben. IWW Gründung im deutschsprachigen Raum

Kirche verklagt Kirche, um Dumpinglöhne durchzusetzen

„Am 19. Mai hat die Bundesregierung den 3. Armuts- und Reichtumsbericht vorgestellt. Als eine der Hauptursachen für die weiter auseinander gehende Schere zwischen Arm und Reich nennt der Bericht zu niedrige Löhne. Am gleichen Tag fand im Arbeitsgericht Herne eine bemerkenswerte Verhandlung statt: Kirche ./. Kirche. Das terminliche Zusammentreffen der beiden Ereignisse ist zufällig. Gleichwohl haben beide Ereignisse einen sachlichen Bezug. In dem Herner Gerichtstermin ging es um eine Klage der Evangelischen Krankenhausgemeinschaft Herne/Castrop-Rauxel gGmbH (Ev KHG), eine 100%ige Tochter des Kirchenkreises Herne, gegen die Evangelische Kirche von Westfalen (EKvW) bzw. gegen das Diakonische Werk derselben. Mit allen juristischen Mitteln kämpfen die Verantwortlichen, die Geschäftsführer Heinz-Werner Bitter und Pfarrer Walter Tschirch zusammen mit dem Aufsichtsratsvorsitzenden Superintendent Reiner Rimkus, gegen die gültigen kirchlichen Tarifregelungen. Ihr Ziel: Löhne deutlich unterhalb der jetzigen Tarifregelungen. Aus der Perspektive des 3. Bundeswirtschaftsminister Glos will Bezieher von Arbeitslosengeld II zur Arbeit verpflichten. Dazu erklärt die stellvertretende Parteivorsitzende Katja Kipping (MdB):

Der Bundesregierung ist es nach wie vor nicht gelungen, die Rahmenbedingungen dafür zu schaffen, dass jeder, der arbeiten will, auch einen Job finden kann. Glos Vorstoß ist ein reines Ablenkungsmanöver und ein Angriff auf das Sozialstaatsgebot. Bezieher von Arbeitslosengeld II sind schon heute verpflichtet, eine Eingliederungsvereinbarung zu unterzeichnen und jedes Arbeitsangebot bzw. jede Fördermaßnahme anzunehmen. Sonst drohen drastische Kürzungen des Geldes. Das führt in der Praxis dazu, dass zunehmend mehr Erwerbslose auch zu tagelanger entgeltfreien Probearbeit bereit sind. Der bereits bestehende Druck auf Erwerbslose schafft nicht mehr Arbeitsplätze sondern erhöht die Bereitschaft zur Selbstausbeutung.

Es geht um rund 140000 Beschäftigte, und der Slogan der AWO - "Kompetenz und Zuverlässigkeit schaffen Vertrauen" - wird zurzeit abermals zur innerbetrieblichen Farce: Die AWO hat das Unternehmertum entdeckt. Ein "Wohlfahrtskonzern" wird angestrebt. ver.di hat jetzt die Verhandlungen mit der AWO abgebrochen, die sich seit April des vergangenen Jahres dahinschleppten.
