Suzanne Swift: from Victim to Accused Army Deserter

Suzanne Swift is bracing for a possible court-martial. Arrested in June for going AWOL, she detailed three alleged sexual offenses to Army officials, who began an investigation. One incident had already been verified and the perpetrator disciplined. But last Friday, the Army ruled that the two other incidents could not be substantiated. It will soon decide whether to take disciplinary action against Swift for her five-month absence, spokesman Joe Hitt said.

Key question ignored

Most people would agree that people become sick with a cold or with the flu when their immune system fails or is suppressed. People and chickens in Vietnam appear much more susceptible to the deadly effects of H5N1. Has anyone considered why their immune system fails to protect them? Has anyone investigated what is suppressing the immune system of migratory birds? I posed the question to Dr. Alex Thiermann, President of OIE (World Organization for Animal Health) at the Bird Flu Summit held in Washington DC in the United States, February 27-28, 2006. He answered: “No one is looking at this, in fact, no one has even thought about it.” Reporters and scientists raised the same point during the coffee break.

I believe that an in vestigation into the immunosuppressive effects of environmental chemicals, particularly dioxins, may shed light on the seemingly scattered and disconnected outbreaks of bird flu around globe. The association between dioxin and influenza may explain the high death rate in Indonesia.

What is Bird Flu?

Influenza viruses are divided into three distinct categories, type A, B, or C, and a large number of subtypes. The outer shell of influenza A viruses is covered with two types of protein antigens: haemagglutinin, (H or HA), and neuraminidase (N or NA). The differences between the H and the N antigens provide the basis for classifying and naming all the many s ubtypes of influenza type A viruses.

Influenza A subtypes are either “mildly pathogenic,” causing minimal or no disease, or “highly pathogenic,” causing serious illnesses and death, particularly among birds. All outbreaks of Highly Pathogenic Avian Influenza (HPAI) viruses since the 1980s have been due to antigen subtypes H5 and H7. The bird flu virus in the news is a highly pathogenic subtype H5N1. Dioxins the most toxic chemical on earth

‘Dioxins' is a general term for a complex family of more than 400 chemicals. Dioxins are by-products of industrial processes that combine chlorine with organic substances such as wood, pulp or paper, in the presence of heat. Production facilities that manufacture pesticides, smelt copper and bleach paper all release dioxins. Dioxins can also enter the environment through the incineration of plastics, particularly those that burn municipal and medical waste.

(WJZ/AP) Baltimore, MD A death row inmate's lawyer argued Monday in federal court that Maryland's lethal injection process could cause "horrific and painful death" in violation of the Constitution's ban against cruel and unusual punishment. But the state contended the process was quick and painless.

WJZ's Adam May has been following the case. May spoke with Evans' lawyer who is arguing the state's method of execution is unconstitutional.

A. Stephen Hut Jr., an attorney for Vernon Evans Jr., attacked the way the three-drug cocktail used in the process are administered. He also questioned the qualifications of the execution team.

Hut said his client's veins have been so badly damaged from years of drug abuse that lethal injection could cause extreme pain without more careful attention than has been available in past executions.

But Laura Mullally, an attorney representing the state, said Hut's argument has a "wolf-in-sheep's-clothing aspect." She emphasized that "an execution is not a medical procedure."

"It is the antithesis of medical treatment," Mullally said, adding that American Medical Association rules prohibit doctors from participating in executions. Mullally said medical records indicated none of the five men executed in Maryland since 1994 felt pain while being put to death.

Hut, however, said Maryland's current protocol for carrying out lethal injection in Maryland must be changed to avoid being unconstitutionally cruel. Hut cited a similar process used in Ohio, which announced plans to change its system in June after experiencing a 90-minute delay in putting a man to death because officials could not find a viable vein to inject the lethal drugs.

Hut said witnesses heard moans and groans from behind a closed curtain as a viable vein was sought, and that a witness will testify in Baltimore about what happened.

Maryland uses three drugs during executions. Sodium pentothal makes the inmate unconscious, pancurium bromide paralyzes the inmate's breathing and potassium chloride stops the heart. State law calls for the lethal injection to consist of an "ultra-short acting barbiturate" combined with a "chemical paralytic agent" to cause death.

Hut said the process needs someone trained with knowledge of anesthesiology to be in the execution chamber while the drugs are being injected in case something goes wrong. He also criticized the logistics of the rooms used in the execution.

Hut also questioned the qualifications of people who serve on the execution team, saying supervisors have a "cursory at best" understanding of participants' past professional and disciplinary records.

The case, which is being heard in federal court in Baltimore by U.S. District Judge Benson Legg, will include testimony from doctors and members of the execution team, whose anonymity will be protected by closing the courtroom to the public when they testify.

Evans was sentenced to die for the murders of Scott Piechowicz and his sister-in-law, Susan Kennedy, in 1983. In February, Maryland's Court of Appeals stayed his execution.

The state's highest court heard arguments in four separate cases in May, including a claim that racial bias played a role in the decision by prosecutors to ask that he be executed.

The court has yet to rule on those cases.

Government officials should pay attention to this assessment.

Earlier this year Bush administration political operatives made an unsuccessful attempt to muzzle climate scientist Jim Hansen, director of the NASA Goddard Institute for Space Studies. Dr. Hansen is now speaking freely about his analysis of the threat of dangerous global climate change. This in itself is a success story. We would like to see more federal climate scientists both able and willing to put forward an assessment of the climate change problem to a wider audience.

But overcoming overt censorship is just one necessary step. We still need to have policymakers and the public pay attention to the analysis, seek to understand it, and give it their most serious consideration. The President saw fit to meet over lunch with science fiction novelist Michael Crichton, author of State of Fear, a piece of pseudo-scientific drivel steeped in the views of the global warming denial machine. We wonder: Are any high government officials having lunch with Jim Hansen and other leading climate scientists?

Hansen's presentation begins with 12 pages of text, which annotates 52 pages of slides, including scientific charts. It should be generally accessible to most attentive non-technical readers. SCIENTISTS BAFFLED BY DECLINE IN WATER LEVELS OF UPPER GREAT LAKES

OTTAWA - Canada and the United States are launching a $17.5-million study to determine why water levels in the upper Great Lakes have declined to near-record lows.

The study by the International Joint Commission will consider a number of possible causes, from climate change to erosion caused by dredging in the St. Clair River.

Environment Minister Rona Ambrose announced $500,000 for the study last week. But officials say that is just the first installment in what will be a major, five-year research effort.

Ambrose noted that water levels in Georgian Bay together with Lakes Huron and Michigan were as much as 45 centimeters below average this summer.

"Clearly, the health of this ecosystem has global significance," she told a news conference at Parry Sound. "Change is already upon us."

Huron and Michigan are at their lowest levels since the 1960s and Lake Superior is at its lowest since 1926, reports the Canadian Hydrology Service at Burlington, Ont.

The decline has caused problems for navigation, recreation, power generation and the ecology of the area. Wetlands are drying up, docks are stranded and beaches in some areas are overgrown with weeds.

"People that have lived along the shoreline and thought they have a million-dollar property no longer do, because instead of having a nice beach or a nice rocky shoreline in front, they've got muck with bullrushes growing in it," said Mary Muter of the Georgian Bay Association.

Citing a study by Blair Associates of Oakville, Muter said the Lake Huron-Michigan water level decreased by 2.4 cm between 2000 and 2005, which she described as a major drop.

"If you converted half a centimeter into volume of water you'd be talking millions of gallons of water."

Yet the lower lakes, Ontario and Erie, are at or slightly above normal levels, which has scientists baffled. Normally, water levels throughout the lakes would rise and fall more or less in tandem.

Computer models simulating climate change predict that water levels will decline throughout the Great Lakes, but don't explain why the upper lakes would be affected more than the others.

"The real thing that's got everybody concerned is not only are Lake Michigan and Huron dropping, but they're dropping relative to Erie," said Frank Quinn, a hydrology consultant at Tecumseh, N.Y.

"The lakes have been low in the past, but the graphs show that all of a sudden starting probably in the late 1980s or early 1990s there came a major difference in the water levels.

"If it was just generally low lake levels you would expect to find the same problem on Erie and Huron."

One possible explanation is that global warming has changed rainfall patterns, said Ralph Moulton at the Canadian Hydrology Service.

There has been unusually low rainfall this year in Northern Ontario compared with the southern part of the province, but it's not clear if that is part of a trend.

Another possible culprit is dredging in the St. Clair River when the St. Lawrence Seaway was being completed. The theory is that the dredging led to accelerated erosion, allowing increased outflow to Lake Erie.

"By dredging they removed the hard covering core of the bottom sediments," said Muter. "Once you remove that layer you expose soft eroding clay to a very high current there."

She said there is a lot of concern about property values around Georgian Bay.

Even though Republicans are balking about supporting Bush's torture proposals, they seem to be caving about saving habeas corpus. Both Warner and Frist versions of the bill strip away the fundamental right to habeas corpus, the right to challenge your detention in a court of law, not to be locked up under the President’s say-so, guilty or innocent, never to be heard from again.

However, an amendment by Specter-Levin will fix this grave problem with the bills.

The rights of victims of rape and sexual assault are also under attack in this legislation, an injustice that is completely under the radar: both bills would change the definition of rape and other torture and cut back on hard-fought victories of victims of sexual violence. Tell your Senators they must uphold the Geneva Conventions and allow survivors of sexual violence to hold their perpetrators accountable.

The ability of homeowners and concerned parents to pinpoint local mobile phone masts, find out who owns them and how powerful they are, has been jeopardised by a spat between telecoms regulator Ofcom and privacy watchdog, the Information Commissioner.

Details of the position of masts - including those for the emergency services' communications network Airwave - are available through SiteFinder, a service set up following the Stewart report into mobiles and health, on the Ofcom website.

But a ruling by the Information Commissioner has placed the site's future in doubt. After an 18-month investigation, the commissioner last week ruled in favour of a request, understood to be from a consumer group, that all the information used to compile the site be made available.

At present that data is used by Ofcom to let people find out who owns masts within about 500 yards of their front door. Searching a wider area merely shows where masts are, not who owns them. While it is technically possible to use a series of local searches to build up a nationwide map, it would take many hours and the data is updated every three months.

The mobile phone companies fear that if all the information is made readily available, it will be easy for competitors to find the "holes" in networks giving them a competitive advantage or allowing rivals to target advertising in specific areas, telling consumers to switch networks if they want better coverage.

The data is provided on a voluntary basis by the five UK mobile networks, Airwave and Network Rail, which uses trackside masts to communicate with drivers. Ofcom can only compel the operators to give data to an accuracy of 100m, which would be pointless in major urban areas where a hectare could include dozens of masts. In addition Ofcom has no way of forcing operators to divulge details of a particular mast's power.

An Ofcom spokesman said the regulator fears that if the ruling is followed, the mobile phone companies will stop giving out the information and SiteFinder will collapse. "We are concerned by the [Information Commissioner's] decision as we believe it may have the effect of removing a source of important information from the public domain," he said. "We are considering our next step." Ofcom has until October 9 to appeal.

A source close to one of the mobile phone networks said the company was very concerned about the impact of the ruling and would almost certainly stop providing information if it was implemented. Ofcom also tried to argue that divulging all information about the location of masts could put the emergency services' communications in jeopardy. But the commissioner rejected this, saying: "Although it would take longer, a determined terrorist or criminal could obtain this information from SiteFinder."

THE WAR CRIMES ACT MUST NOT BE CHANGED AT ALL

There is an apocryphal tale about a child who, having failed to perform an assigned task, invented the most outlandish excuse for why he could not produce the required finished work. We cannot say if there ever was an actual child who claimed that the dog had eaten his homework. But we have its equivalent now in the current president of the United States.

The incredible world spectacle we have is this. First, the president demands that the War Crimes Act, the law of the land, be changed to accommodate the crimes that have ALREADY been committed at his direction, specifically to authorize methods of torture previously and rightfully considered verboten. If this is not a naked admission that he has broken the law in the most hideous way we don't know what is. Second, and at the same time, he is demanding that new laws enacted be to hotrod the prosecution of those he personally deems enemies of the state. What is he trying to tell the world, that those people CANNOT be convicted of an offense under our current law, but that he himself cannot ESCAPE conviction under that same law for what he has done?

Shame on any member of Congress who signs on to any of this in any part. Let us address each of these two points in turn

THE WAR CRIMES ACT MUST NOT BE CHANGED AT ALL

If there was an Olympic event for hypocritical lying, the Bush administration would have no peer anywhere. But perhaps the biggest honking lie of all is that the torture of our detainees has given us any intelligence to make us safer. Indeed, it was information extracted by torture (of Ibn al-Shaykh al-Libi) that was used as an EXCUSE by the Bush and Cheney that it was so drop dead critical to attack and occupy Iraq, now recognized by all with an honest bone left in their body as the greatest strategic blunder in our nation's military history. It is all contained in the Phase 2 Senate Intelligence Committee Report, which Cheney claims not to have read himself.

Those who really know interrogation know that information extracted by such means is BAD intelligence, notwithstanding the most extreme "ticking time bomb" scenario the Bush regime constantly throws in our faces. But just as they have systematically done in every other policy area without exception, those who actually know what they are talking about have here again been muscled out of government decision making. We are told for example that the military JAG attorneys were held for hours in a meeting and not allowed to leave until they signed on to the president's demands.

And now Bush directly threatens the American people by saying if they will not rubberstamp his torture program as is, he will scuttle it. That's exactly akin to a bank robber threatening to stop robbing banks unless we change the laws to his specifications. Of course it has to stop. When we have a program that is so destructive to our REAL national security it absolutely MUST stop. Maybe then, just maybe, we could get back to obtaining good intelligence of actual value. But Bush in his patented flim-flam way would make it sound like his critics would have us stop all intelligence operations to protect our families.

They have their talking point, that the law needs to be "clarified", and they are going to keep repeating it like a broken record until we all run screaming from the room. The problem is that they KNEW they were breaking international and U.S. law when they did it, in the most premeditated way, and were so warned in advance by their own attorney general in no uncertain terms. Part of the language they would now unilaterally and retroactively excise from Article 3 of the Geneva Conventions refers to "outrages upon personal dignity, in particular humiliating . . . " At Abu Ghraib, Bush administration henchmen DESIGNED methods of treatment with the deliberate intent of being maximally offensive to their Muslim victims, most of whom were innocent of any crime whatsoever.

If war itself were not enough of an atrocity, when the depth of the horrors of World War II came to light some to the greatest legal minds ever labored to define in words what civilized people must forever proscribe, even in war. And in the Geneva Conventions they succeeded. Any who dare to violate these mutually accepted definitions of despicable behavior are guilty of war crimes on their face. We need NOT behave as monsters ourselves to protect our people. Such acts only lead to the remaining civilized people in the world shunning us as pariahs, to never again volunteer the good intelligence we really need to thwart those who mean us harm.

In fact, the Bush administration has repeatedly jeopardized intelligence operations of REAL value to score media propaganda points. The British were furious two years ago when they outed a very valuable mole in Al Qaeda, thereby doing incalculable damage to our ability to stop the bad guys. And they did it again by pressuring the British to move prematurely on the recent airline plot, related to so-called "liquid explosives" which had no chemical possibility of ever being operational. The case against those plotters and their associates is accordingly weaker than it would have been otherwise.

Keep in mind that in both the above situations informants were gained by winning people to our side. Such intelligence losses cannot be compensated for by stooping to torture methods which have the exact OPPOSITE effect.

DETAINEES MUST BE PROSECUTED UNDER CURRENT LAW

The fact that the detainees HAVE been tortured is precisely the reason why the Bush administration is so determined to deny them any rights they have under current law to see the evidence against them, or to have any other protections thereunder. Secret evidence means keeping also secret their own war crimes. Either we are a nation of laws or we are not. And to butcher the law "ex post facto" (after the fact) anytime the result will not be as we would like is to render our entire legal system of no force and effect. It is to tell the world that we have laws of convenience only, and that they are subject to change without notice.

There are disreputable precedents in world history, the Star Chamber, kangaroo courts and show trials. The Supreme Court, even stacked as it is already is with Bush beholden appointees, has ruled that the military tribunals proposed are contrary to the Constitution itself, let alone statutory law. The solution is not to enact further Constitutional outrages in the Congress, perhaps in hopes of stacking a contrary deciding fifth additional vote by the time it arrives back at the Supreme Court.

The detainees must be prosecuted under existing law. To do otherwise is to send the loudest message possible to the entire world that we believe THEY HAVE COMMITTED NO CRIME FOR WHICH THEY CAN BE PROSECUTED. Some who were irrefutably innocent have already been released after years of torture, and with no apology or compensation for their ordeal. If the truly guilty cannot be found so under current law, we have no moral standing in the world left at all.

There's a ticking time bomb alright, but unfortunately it's our own current president of the United States. Day by day he becomes more pugnacious and more defiant. It is just a matter of time before he commits an atrocity in our name so heinous that no American will ever be safe ever again anywhere in the world, unless he is peacefully and swiftly removed from office.

And if a dog did eat his homework, it would have been a dog of war.

Am heutigen Nachmittag tauchte überraschend eine Gruppe von 7 ÜBERFLÜSSIGEN in der ostdeutschen Kleinstadt Aschersleben im "E-Center" in der Geschwister-Scholl-Str. auf. Getreu dem neuen gastronomischen Trend, "All you can eat", folgend, begannen sie in der Lebensmittelabteilung in die Regale zu greifen und stillten ihren Hunger. Rüdiger S. erwartet, dass ihm entweder eine sozialversicherungspflichtige Arbeit vermittelt, oder aber eine bedarfsgerechte Sozialleistung gezahlt wird. Er ist nicht bereit für einen Euro zu arbeiten und trotzdem zu frieren. Er wird den Hungerstreik erst beenden, wenn die ARGE die 30%ige Kürzung seiner Regelleistung zurück nimmt.

The Bush administration and holdout GOP senators expressed confidence on Sunday they could reach a compromise on rules for CIA interrogations of suspected terrorists. Neither the president's national security aides nor some of the lawmakers who are resisting White House pressure would say how they can reconcile their deep differences after a week of public sparring. As a result, it is unclear if Congress quickly can pass legislation authorizing aggressive methods against terrorist detainees, as President Bush wants. Congress is likely to adjourn in two weeks for the fall elections...
