Das Telefonieren mit dem Handy am Steuer: lediglich ein Kavaliersdelikt?

In der Samstagsausgabe der SN vom 8.7.2006 wurde auf die Ergebnisse einer Studie aus den USA hingewiesen, wonach Personen, die mit Handy oder Freisprecheinrichtung telefonieren, vergleichbare Defizite wie Autolenker mit einem Alkoholwert von 0,8 Promille aufweisen. Es überrascht nicht, dass dem amerikanischen Gesetzgeber darauf die Untersagung von Telefonaten mit dem Handy während der Fahrt empfohlen wurde. Sieht man sich die Situation auf Österreichs Straßen an, möchte man meinen, bei uns müsste ein solches Verbot erst gesetzlich eingeführt werden. Dem ist aber nicht so: § 102 Abs. 3 Kraftfahrgesetz (KFG) sieht nämlich ausdrücklich vor, dass dem Lenker das Telefonieren während des Fahrens ohne Benützung einer Freisprecheinrichtung verboten ist.

Laut einer von der Mobilkom Austria in Auftrag gegebenen Studie verwendet nur jeder zweite Handybesitzer, der in seinem Auto telefoniert, eine Freisprecheinrichtung. Dementsprechend hoch ist das Unfallrisiko: Es ist fünfmal höher als jenes von Lenkern, die auf ein Telefonat während der Fahrt verzichten. Ungeachtet dessen ist die für derartige Verwaltungsübertretungen vorgesehene Geldstrafe äußerst bescheiden, sie beträgt sage und schreibe 25 Euro! Das heißt, wenn jemand hinter dem Steuer mit dem Handy am Ohr erwischt wird, kommt er mit diesem Geldbetrag davon – vorausgesetzt, er wird von der Polizei angehalten! Nach der derzeitigen Rechtslage können Lenker, die mit ihrem Handy während der Fahrt telefonieren, nämlich nicht angezeigt werden, solche, die ein anderes Verkehrsdelikt begangen haben – etwa die Überschreitung einer Kreuzung bei Rotlicht – sehr wohl. Dramatisch ist die Situation vor allem für jene Verkehrsteilnehmer, die dem Ganzen schutzlos ausgeliefert sind: Bei Beobachtungen des Kuratoriums für Verkehrssicherheit (KfV) drosselten über 70 % der telefonierenden Fahrer weder das Tempo, noch hielten sie an, wenn ein Fußgänger die Straße queren wollte. Mit Recht fordert das KfV verstärkte Kontrollen der Autofahrer durch die Polizei (sie sind leider Mangelware) und eine Erleichterung der Sanktionierungspraxis für die Exekutive.

Nach ständiger Rechtsprechung des Europäischen Gerichtshofs für Menschenrechte wird durch Art. 2 der Europäischen Menschenrechtskonvention (Recht auf Leben) ein Anspruch jedes Menschen auf Bewahrung seines Lebens sichergestellt und den Staaten aufgetragen, diesen Anspruch durch rechtliche Vorkehrungen zu schützen; ein Auftrag, der sich vor allem an den Gesetzgeber wendet, in bestimmtem Umfang aber auch an die Vollziehung. Die staatliche Schutzpflicht setzt allerdings nicht erst dann ein, wenn der Einzelne von einer vorsätzlichen Tötungshandlung betroffen ist, vielmehr besteht der Schutzanspruch gegen den Staat auch schon gegenüber potentiellen Lebensgefährdungen.

Es wird nun jedem einleuchten, dass die für die Verwendung von Handys am Steuer festgelegte Strafe schwerlich geeignet ist, Autofahrer vom Gebrauch ihres Handys abzuhalten. Nähme der Gesetzgeber seine Verantwortung bezüglich der Bewahrung des Schutzguts Leben tatsächlich ernst, müsste er die besagte Geldstrafe drastisch erhöhen, die Polizei anweisen, verstärkt Schwerpunktkontrollen durchzuführen und auch das Telefonieren per Fernsprecheinrichtung gesetzlich verbieten.

Ähnlich wie beim Ruf der Bevölkerung nach einem effektiven Rechtsschutz gegen gesundheitsschädliche Auswirkungen durch „Handymastenstrahlung“ sind die verantwortlichen Politiker bisher untätig geblieben. Somit stellt sich einmal mehr die Forderung nach der gesetzlichen Einräumung einer Beschwerde wegen gesetzgeberischer Untätigkeit an den Verfassungsgerichtshof. Ferner sollten Politiker generell haften, wenn sie es verabsäumt haben, notwendige Vorkehrungen zum Schutz des Lebens und der Gesundheit der Bevölkerung (hier: der Verkehrsteilnehmer) zu treffen.

Übrigens bestehen gute Gründe für die Annahme, dass § 134 Abs. 3c KFG (er legt das Strafmaß für das Telefonieren mit dem Handy während der Fahrt fest) wegen Verstoßes gegen Art. 2 EMRK verfassungswidrig ist. So könnte etwa der Verfassungsgerichtshof mit der Begründung angerufen werden, diese Bestimmung sei angesichts des darin vorgesehenen geringen Strafrahmens nicht geeignet, das Leben der Verkehrsteilnehmer angemessen zu schützen. Ferner stellt sich die Frage, ob § 134 Abs. 3c KFG nicht auch gegen den in Art. 7 der Bundesverfassung verankerten Gleichheitsgrundsatz verstößt. Es ist nämlich nicht ersichtlich, warum im Bereich des unerlaubten Telefonierens am Steuer andere Maßstäbe gelten sollten wie etwa in Bezug auf das Fahren über die Kreuzung bei Rotlicht (das mit wesentlich höheren Strafen geahndet wird, wobei bereits eine Anzeige genügt), da beides gleichermaßen gefährlich ist und Schutzziel hier wie dort die Sicherheit der Verkehrsteilnehmer ist.

Keeping pressure on in phone mast battle

ANGRY parents have staged a demonstration at the building site of a mobile phone mast.

Despite being just two weeks away from giving birth, campaigner Elizabeth Canavan, 35, joined the demonstration to try and stop the T-Mobile mast being erected in Aldersbrook Road, near Aldersbrook Primary School.

She said: "Phone companies talk about acceptable risks but we are not prepared to accept any risks involving our children."

Mast not wanted near new homes

Families moving into new houses could find they have an unwelcome neighbour - a 25 metre high mobile phone mast.

Mobile phone firm Three, formerly Hutchison 3G, was to install a mast with dishes and equipment on land owned by Toucan Hire Services in Havers Road, Mile Cross.

Protesters have sent objections to Norwich City Council and say it would be unfair to families moving into new homes being built next to the site.

The area used to be used for industrial purposes and was used by Harmers shoe factory, but in the last couple of years hundreds of homes have been built on the site - with the next set of homes currently being built due to be occupied later this month.

It comes just days after the Evening News reported how Three wants to put up a mast just yards from Eaton Park and families living nearby.

Steve Morphew, Labour leader of the city council, said: “We have got an area which has gone from being an industrial area to being a very nice residential area.

“Putting an 81 foot aerial there might have been fine for what the area used to be, but isn't now. The visual intrusion is the reason we want to object.

“Of course people are concerned about the health implications, but I think we have a strong case against giving planning permission based on the visual impact.

“There is a real sense of unfairness about the people who will be moving into the houses nearby. They won't have had the opportunity to know the mast is proposed.

“It might be some people had done searches on their home before this application was put in and do not know it has been submitted.”

Mr Morphew said he had put in a letter of objection on behalf of about 20 people who live in the homes that have already been occupied on the site.

One of the objectors, a 41-year-old graphic designer, who lives on Junction Road opposite the site of the proposed mast, said he was worried that radiation outfall could be cancerous and the mast would be a blot on the landscape.

He said: “They should put it up on the Sweet Briar Industrial Estate which is not near homes. It will stick out like a sore thumb whenever I look out of my window.

“It is going to tower 30 feet above the trees and will destroy the look of that lovely green space of Anderson's meadow.”

Another objector John Russell, who lives on Drayton Road, said: “I don't like the way that Norwich City Council is going about this. It's inappropriate that they should push this through before the residents move in.

“They should defer it until the residents have been consulted. These families are going to move in and they won't want this big contraction on their doorstep.”

William Comery, spokesman for Ericsson Services Ltd, which is setting up the masts on behalf of Three, said it would be up to the planning authority to decide on the mast.

But he said: “We looked at about a dozen to 15 possible sites in that area and approached various freeholds. This was the only one which came through in terms of meeting our needs, but was also the most suitable in fitting in with the environment.

“It is in a group of industrial units, 50 metres from the road and further away from residential properties.”

The Evening News 'Put Masts On Hold' campaign has called for no mobile phone masts to be installed near homes or schools until they are conclusively proved to be safe.

RESIDENTS' FEARS OVER MAST PLAN

RESIDENTS want to see a mobile phone mast scheme kicked into touch at a sports ground.

Complaints have been lodged with South Tyneside Council about plans to place a telecommunications mast at Hebburn Sports and Social Club.

The plans by mobile phone company 02 (UK) Ltd, of Leeds, include the demolition of an existing 16.5m high lattice tower and floodlights at the north west corner of the site in North Drive, off Victoria Road West, and the construction in the same location of a new tower of the same height, incorporating three telecommunications antennas, floodlights and two microwave dishes.

But nearby residents are unhappy about the plans, citing health fears and possible damage to property values.

John Shippen, of North Drive, Hebburn, who plans to speak out against the mast plans at a future council meeting, said: "Basically, I think it will be in the wrong place and there are still health fears about mobile masts."

Neighbour Thomas Johnsen added: "We already have problems with double parking when football is played at the ground.

"We have spoken to local councillors about the mast and we hope to get their support.

"A petition will also be going around the estate, because we have been told that will carry more weight with the council."

A planning spokesman confirmed that a dozen letters objecting to the mast scheme have already been received by South Tyneside Council.

A council consultation exercise about the plans has been under way for some time.

Mary McNabola, another North Drive resident, said: "I don't think the mobile mast should be so close to people's homes.

"I think people are also worried about the possible effect on house values."

Coun Eddie McAtominey, for the Hebburn South ward, said: "I have met with residents in the area and it's clear people are unhappy about the mast being placed so near their homes.

"South Tyneside Council owns the land and leases the site to the sports club and I don't think Hebburn ward members will look on this application favourably."

No one was available for comment at Hebburn Sports and Social Club.

Mast is rejected

PLANS to put a mobile phone mast on a house roof in Erith have been rejected by the council.

Applicant Hutchinson 3G wanted to install three antennas, two dishes and associated radio equipment on the roof of the house at 172 Park Crescent.

The mast and equipment was proposed to be hidden within the house's roof spire.

Councillors rejected the application owing to the adverse impact on the architecture, insufficient information on emissions from the mast and alternative sites hadn't been explored.

I sent them a letter along with some info such as the Athens court case where 10 towers were ordered down for health reasons and the Frieburger Appeal.I received a phone call that day from the Mayor who has set a date for me to address council. Harrison Hot Springs is the Village where I suffered in my home by the tower to the extent that I had to move.I have since sold the home and I have been waiting for good news such as the Athens Court case. I would greatly appreciate any letters of reinforcement from those with knowledge and or personal experience of living near towers telling council why a tower that houses TV,FM radio and cellphone antennas should not be placed close to homes. Back in 1995 I purchased a home on Pine Ave.in HHS which was situated aprox 350 feet from the CBC broadcast tower which also houses cellphone and FM radio antenna's.Within one year I became so ill that I had to move from that home.I soon discovered that the radio waves from the tower was the cause of my illness.Since that time I have devoted to research on the subject and have found that many people around the world have become ill from cellphone towers near their homes and some have had to move as I did. While living in HHS I contacted Industry Canada,Health Canada and BC Radiation Protection Office in Burnaby and could not get any help. They all deny that there could be adverse health effects from towers even though there are many studies that show biological effects. There are surveys that have been done that show illness from radio waves. Please read below. I srongly suggest ,for the protection of public health,that you insist that the CBC remove the tower on McCoombs Street. I would like to address council if you are interested.Please call 604 8266791. This letter is written in support of Robert Riedlinger, who has asked to address council and is trying to make you aware of the dangers of electro magnetic radiation (EMR) from antennas.

I live in south western Ontario and have been badly affected by EMR emissions from antennas and the electrical system. I also (same as Robert) had to move out of my own home due to the terrible effects from EMR. During the last two years I have found clear evidence that cell phone antennas, broadcasting antennas and other strong sources of electro magnetic radiation are causing cancer, sleep depravation and many other unpleasant and dangerous health effects to persons exposed to EMR. That evidence, is in the form of much research by scientist in countries throughout the world, the observations of many doctors around the world and the stories of victims who have been affected. I am in touch with many other persons in Canada who have been seriously harmed by EMR emissions.

I encourage you to listen closely to Robert Riedlinger and to study some of the research that is available about the dangers of EMR. It appears that there is a period of time, possibly as long as ten years for EMR to cause serious damage to health. There is no point waiting for your citizens to become ill, develop cancer or die. You can take action now that can safeguard your community for the years to come. I have attached a few documents that may assist you to understand the dangers that we all face. I have many more documents and will gladly assist you, if I can.

Phone company takes down controversial mast

A CONTROVERSIAL phone mast in High Wycombe has been pulled down to the delight of neighbours who have campaigned for six months to have it removed.

The 45ft mast in Arnison Avenue was dismantled last Tuesday just as Barry Evans, founder of the NO2 Mast Group, was preparing to fight the mobile phone giants before a judge the next day.

Mr Evans, 59, from Amersham Road, said: "I am pleased. It shows that you need to push them and they will back down. This could all have been sorted over a cup of coffee weeks ago."

The mast was put up in February despite O2 failing to get planning permission from Wycombe District Council after the company used a legal loophole.

The phone company realised the council had missed the deadline to respond to its application by one day, giving it automatic permission to install the mast. The council has 56 days to respond to applications.

Jim Stevenson, from O2, said it was a "coincidence" that the court case was the next day and promised the mast would not be making a reappearance.

He said: "We have tweaked a few of our other antennae and we realised we don't need this one any more. It will go back in storage and be used somewhere else in the country."

Tories in call to abolish councils watchdog

Members 'denied right to speak on key issues'

LEADING Tories have attacked a local government watchdog created by John Prescott's former Department, and called for its abolition.

The Standards Board for England is accused of overseeing a regulatory system which denies councillors the right to speak on key issues affecting their communities because of a tough interpretation of rules governing personal interests.

A report drawn up by Owen Paterson, Tory Shadow Transport Minister, and Gerald Howarth, Shadow Defence Minister, details a series of instances where councillors have allegedly been barred from speaking out because of the monitoring system and Code of Conduct brought in by Mr Prescott's former Department, the Office of the Deputy Prime Minister.

Much of the issue revolves around the interpretation of a councillor's personal interest in an issue.

The Tories contend that the current Standards Board regime is encouraging a nonsensical view which effectively could stop councillors doing the job they were elected to do.

It also involves so-called "predetermination", under which councillors are expected to have an open mind before reaching a decision, apparently precluding the expression of any strongly held opinions prior to then.

The report cites the example of senior council officials in Chester and Reigate and Banstead councils, who wrote to all candidates standing for election earlier this year telling them that they must avoid mentioning any controversial local issues during campaigning because, if they were elected, it would it disbar them from taking part in any discussion of those issues in council.

And in one of the more bizarre examples, the report says that members of South Cambridgeshire District Council have been told by their monitoring officer that they might be disqualified from discussing the siting of a mobile phone mast if they themselves used a mobile phone. Neither could they pronounce on a park-and-ride scheme if they drove a car, the report adds.

It concludes: "This would appear to negate the very basis of representative democracy. Voters, it would appear, cannot expect a councillor to hold fixed views on anything or to represent their views in the debating chamber."

Last night, a spokeswoman for the Standards Board said: "A lot of the report seems to concern the common law principle of bias and predetermination as it has been interpreted by the courts and the Court of Appeal.

"This predates the Standards Board for England and the Code of Conduct by many years.

"We have recently consulted with local government and put forward proposals for a revised Code of Conduct suited to modern community based local government. We expect the Local Government Minister to put a revised code to Parliament very soon.

"We receive around 300 complaints a month, the majority from members of the pubic who feel their elected representatives have, in some way, fallen short of their expectations. We believe they need the confidence of an independent body that ensures that their concerns are addressed."
