A draft bill in the US senate will give President broad powers in the event of a ‘cybersecurity emergency.’ An earlier draft of the bill, which explicitly allowed the White House to disconnect private computers and networks when deemed necessary, was widely criticized. Instead of granting precise powers, the new proposal from Jay Rockefeller (D-W.V.) would give the President the power to do whatever he deems necessary to ‘direct the national response to the cyber threat’ whenever he ‘finds it necessary for the national defense and security.’ This would presumably include the disconnection of suspicious users and vulnerable targets, with no clear guidelines on when this is appropriate. The emergency powers seem to be restricted to ‘cybersecurity threats’ to ‘critical private networks.’ While preventing malicious attacks on important networks is a worthy goal, the emergency powers remain deeply troubling...
