Reject An Attorney General Who Won't Up Hold The Law
At his senate hearing, Michael B. Mukasey, President Bush’s nominee for attorney general, was plainly asked if the president is required to obey federal statutes.
Not only did he refuse to answer that question with an unqualified "Yes", the basis for his refusal was basically that a war president can do whatever he likes, the catchall Constitution buster of the current administration.

We knew up front that there was no chance that the Cheney administration would willingly tender a nominee who would even contemplate holding them accountable in any way for their wholesale defiance of the law. When the position of Gonzales became untenable, they went ideological crony shopping and found a willing collaborator in Mukasey. But that doesn't mean we're not supposed to vociferously object.
While otherwise being diplomatically polite, former assistant U.S. attorney, and professor of constitutional law at Yale Law School, Jed Rubenfeld, editorialized in the New York Times this week that, "If Judge Mukasey cannot say plainly that the president must obey a valid statute, he ought not to be the nation’s next attorney general.
But of course Mukasey has already placed his compromised position in the record. There is nothing left for him to do now but try to snake around his real character, as some judicial nominees we could mention, who implemented their full, hardcore, right wing agendas only after confirmation.
Update: Even as we were starting to transmit this alert, a new controversy surfaced around the Mukasey testimony, when he would not say whether he believed that waterboarding qualified as torture. What part of almost drowning someone, and sometimes actually drowning them, doesn't he get? Even if torture yielded good intelligence, which it does not, we are not interested in becoming a nation of international war criminals.

Members of the Senate are even now speaking out in opposition to this flatly unacceptable nominee. Please join them. We need to encourage those who are speaking their conscience. If the Senate can reject torture 90-9, they can certainly reject this "see no torture" nominee, who would determine that the president does not have to obey that law, which he had already acted to abort with a contradictory signing statement in signing it at all.
Even now, some sources are suggesting Alberto Gonzales is likely to be prosecuted for his perjury before Congress in the purge of any U.S. Attorney who could be politically corrupted. That's what we the people get when Congress does not demand an attorney general who isn't totally beholden to the White House. This time we expect them to do a better job of protecting us.
There can be no redemption for Mukasey. Our job is to keep throwing them back, and not tire, until and unless we get one who will actual follow the law without equivocation.
