Latest 5-4 Ruling Further Proof of the Alito Effect

http://www.commondreams.org/news2007/0529-08.htm

--------

Injustice 5, Justice 4

The editors of The New York Times write: "The Supreme Court struck a blow for discrimination this week by stripping a key civil rights law of much of its potency. The majority opinion, by Justice Samuel Alito, forced an unreasonable reading on the law, and tossed aside long-standing precedents to rule in favor of an Alabama employer that had underpaid a female employee for years. The ruling is the latest indication that a court which once proudly stood up for the disadvantaged is increasingly protective of the powerful."

Phone Mast Campaigners 'Lucky' to Have Support

A Kenilworth woman has hit out at The Open Spaces Society for not supporting a previous fight against a mobile phone mast on Chase Lane in the town.

Louise Weetman of East Chase Farm says that the society was 'not interested' in their battle against a mast and says that residents of Crackley Lane are 'lucky' to have the support they do.

Plans for the HG3 mast were granted permission in December 2006 after perceived health risks could not justify the application being refused, according to Warwick District Council.

But at the time, Ms Weetman says that the small number of supporters fighting against the plans rendered their campaign futile in the eyes of planners.

She said: "We in Chase Lane are so few and had no such support therefore the application for a mast in our beautiful privately owned lane was approved.

"Ninety eight per cent of the residents did not want the mast in the location chosen in Chase Lane. To call these telephone companies a communication company is laughable the last thing they do is communicate with you.

"What is also amazing is that The Open Spaces Society were not interested in helping us with our campaign, now it effects their land they are willing to get involved.

"Kate Ashbrook, the site in Chase Lane is also an 'historic site where people enjoy quiet recreation. It will be an eyesore and will spoil the natural beauty of the area'.

"Where were you when we needed your support? Chase Lane residents put forward all the same arguments as those being put forward by the Crackley Lane residents.

"I wish Crackley Lane luck with their fight and if they win Chase Lane residents will feel vindicated that they were indeed victims of bully boy tactics by the telephone company, Kenilworth town councillors who approved and the planning officers simply because we were so few in numbers."

The Open Spaces Society announced its decision to join the campaign against the O2 mast which may be destined for Crackley Lane.

The society owns Parliament Piece in Kenilworth and is concerned that Warwick District Council has failed to so far consult the society as an adjoining landowner.

In 1999 the society leased the land to Warwick District Council under a 99-year lease, to manage for nature conservation, public recreation on foot, and as an important contribution to the landscape character of the area.

Protesters against the O2 mast on Crackley Lane turned out in force last week to demonstrate against the plans.

And on Wednesday, they joined together to submit a 400-signature petition to the district council. Neighbours in the locality are protesting about the proposed telephone mast that could be placed at the corner of Crackley Lane and Coventry Road.

The location would site the mast approximately 70m from nearby houses and about 70m from the tennis courts at Kenilworth Tennis Club. Protesters are asking district councilors to think about an alternative site.

Kenilworth town councillors are unanimous in their opposition Warwick District Council has yet to comment on this further.

Mast plan for village dropped

A mobile phone giant behind a plan to construct a 28-metre mast has withdrawn the scheme.

Hutchison 3G UK Ltd submitted a plan to put up the tower in Gidding Road, Sawtry, near Peterborough, last month.

The company was seeking planning permission to site the temporary mast for a year.

However, officials from Hutchison 3G have now informed planning chiefs at Huntingdonshire District Council that they no longer want the application to be considered.

Journalists say they are not allowed to cover the reality of war, and that "this has got little to do with the families or the soldiers, and everything to do with politics."

Spezial-Unterhosen sollen vor Handy-Strahlen schützen

http://www.xonio.com/news/news_26578691.html

Kommentar:

Memorial and Veterans Day hypocrisy

Common Dreams
by Stephen Lendman

05/28/07

Because both days are related, they’re discussed together. The first, Memorial Day, is commemorated on the last Monday in May and was first observed in 1866 and called Decoration Day beginning in 1868. Usage of Memorial Day wasn’t common until after WW II and wasn’t the holiday’s official name until federal law called it that in 1967. The day is an occasion to honor the nation’s men and women who died in military service to the country. … Both holidays wouldn’t be needed in a nation dedicated to peace, but one committed to perpetual war for an unattainable peace dishonors its youth in life and disingenuously honors those who died in imperial wars for conquest and plunder...

The temporal illusion

LewRockwell.Com
by Per Bylund

05/29/07

How come we as humans always tend to realize the real risk of horrors tomorrow, but not understanding the horrors that are already upon us? We are not at the brink of an Orwellian police state — it is already here. The wars on drugs, terrorism, poverty, and Iraq aren’t approaching failure — they have failed, and failed good. People say we should learn from history or we might relive its horrors — history tends to repeat itself because we don’t know about it or consider our collective experience of sufficient importance. There is truth to these words, but why do we think people could learn from history when most of us regularly fail to identify the nature of the now? If we cannot even see what we’re in the midst of, then how can we expect to learn from the experience of previous years — or even previous generations?

For some people, the key to happiness is low standards. If you never expect much out of life, you will rarely be disappointed, and you will be content with outcomes that others would find unbearable. It’s a formula that is working quite satisfactorily for President Bush and many congressional Republicans in the controversy over the U.S. attorney firings. Monica Goodling, who was an aide to Atty. Gen. Alberto Gonzales, agreed to appear before a House committee only after pleading her right against self-incrimination and then getting a grant of immunity. Here’s a good rule of thumb: Innocent people who are prepared to tell the truth don’t take the Fifth. Lebensfremd und unverschämt

#Die Linkspartei.PDS: Pressemitteilungen

29. Mai 2007

It is average Americans, not “experts,” who must draw a line as to what they will tolerate. Until that happens, all the psychologists, medications, counseling services, and screening instruments in the world will not be enough to prevent the “mad” rampages that increasingly define our era......

Paying Less to Pollute: Environmental Enforcement Under the Bush

Enforcement actions by the EPA in the most recent five full fiscal years of the Bush Administration have fallen on four out of five key fronts compared to the last five years of the EPA under Clinton. EPA enforcement is down by about a quarter or more in terms of court filings, criminal investigations, civil fines and criminal penalties. The Justice Department has become reluctant to sue violators that refuse to settle.

Palm Oil Puts Squeeze on Endangered Orangutan

Bound hand and foot, disheveled orangutans caught raiding Borneo's oil palm crops silently await their fate as a small crowd of plantation workers gathers to watch. Lacking only handcuffs and fingerprinting to complete the atmosphere of a criminal bust, such "ape evictions" have become part of life for Asia's endangered red apes.

Trust and Betrayal

"Future historians will shake their heads over how easily America was misled into war. The warning signs, the indications that we had a rogue administration determined to use 9/11 as an excuse for war, were there, for those willing to see them, right from the beginning - even before Mr. Bush began explicitly pushing for war with Iraq," writes Paul Krugman.

Mast victory for residents who stood up to club

May 28 2007

by Lisa Jones, South Wales Echo

A FIGHT to keep a mobile phone mast from being put up in a rugby ground has been won.

Plans to erect the T-Mobile mast in the grounds of Glamorgan Wanderers Rugby Club, Ely, Cardiff, were shelved after its board of trustees opposed them.

Residents living near the ground in Stirling Road, Ely, were horrified by the prospect of having to live next to the 20.5-metre-high mast and organised a petition against it, collecting 168 names.

They were concerned it could put people’s health at risk and would be a blot on the landscape.

Representatives also voiced their concerns to club officials, who finally relented after its trustees’ meeting.

Derek Patterson, club secretary, said the club withdrew its support in response to opposition from residents.

He said: “There was a lot of concern expressed by the local residents.

“At the end of the day we decided in the interests of keeping good relations with the neighbours that we wouldn’t go ahead with it.

“It’s important to us to keep good relations. We didn’t want to antagonise anybody.”

Keith Bratcher, 56, a lorry driver of St Fagans Court, led the campaign.

He said: “It goes to show that if enough people stand up to be counted, the big boys can be taken down.

“They can’t ride roughshod over everybody.

“It hasn’t been proved that these masts are safe, but it would have altered the skyline completely.

“Nobody is entitled to a view but I’ve had mine for 25 years.

“It’s a wonderful achievement but I’m still keeping a close eye on the situation.”

Retired police officer Trevor Tibbles, 72, whose house is next to the club, said it was good news their concerns had been listened to.

“I’m highly delighted,” he said.

“It’s nice to see that somebody has listened.

“Sometimes you can protest as much as you like but it doesn’t change anything.

“We heard that the Glamorgan Wanderers trustees had put their foot down and said ‘no’. It wouldn’t have been in their best interests to alienate the people.”

A spokeswoman for Cardiff council confirmed that the plans to put up the mast at Glamorgan Wanderers RFC were withdrawn by T-Mobile before a planning committee meeting on Wednesday.

Manx doctors' concern over phone masts

von Conrad Murray

A medical practice is considering moving to new premises amid concerns about possible health risks posed by mobile phone masts on their building.

There are now five masts on the roof of the Health Centre in Village Walk, Onchan - two operated by Manx Telecom, the other three by Cable and Wireless. The doctors are still not convinced that emissions from the masts pose no risk to health. They are particularly concerned about possible risks to children.

The Island's Public Health consultant, Dr Paul Emmerson, said there was still no proof that exposure to electromagnetic radiation from the masts caused any illness.

GP Dr Jim McAllister said he would rather err on the side of caution.

Fears over mast plans

By Ellie Simmonds

Proposals to extend a mobile phone mast near Bicester town centre have sparked concern among councillors.

Mobile phone company Orange wants to replace a 15m mast on land off Alchester Terrace with a 20m one.

Bicester Town Council has decided to object to the plans. Councillor Nick Cotter, whose Bicester South ward includes the mast, said: "There are concerns about these masts."

He raised fears about so-called cancer clusters which, it has been alleged, occur around masts. He said: "Two of my kids go to St Mary's School and there's a huge great mast there. I just think we should find out more about these things."

Fellow councillor Les Sibley said: "We should ask for a risk assessment. We want to know what impact these masts will actually have on people's health."

But town clerk Anne Wilson said in a letter accompanying the application that Orange had claimed that its design of mast had already won local authority approval.

Newly-elected councillor Nicholas Mawerok said: "Orange coverage within Bicester isn't particularly strong. There are areas in some estates where you can't get any coverage whatsoever. The business community would probably welcome some coverage."

Councillors voted to pass their concerns on to Cherwell District Council, which will make a final decision on the plans.

The Kakistocracy Exposes Its Hand

by Edward Vieira, Ph.D., JD

The publication of National Security Presidential Directive 51 (Homeland Security Presidential Directive 20) on 9 May 2007, now available on the White House’s web site, represents another major stage in the devolution of the United States from a constitutional republic to a Caesaristic police state. Inadvertently, though, it exposes the primary danger to the continuation of its own power that the Establishment now fears. As well, it emphasizes the impossibility of any succor for the American people from the present “two” major political parties......
