White House OKs Massive Pentagon Budget Increase

The White House has approved a $468.9 billion budget for the Pentagon in fiscal year 2008, a six percent increase over last year's request, according to a Defense Department document obtained by Reuters. It is also asking the Pentagon to cover some Army and Marine Corps war costs in Iraq and Afghanistan as part of the regular budget, rather than through emergency budget requests. The 2008 budget request is $4.7 billion more than the level the Pentagon forecast in its 2007 budget documents.

In Torture Case Against Rumsfeld, Lawyers Cite “Widespread Pattern” of Abuse

Secretary of Defense Donald Rumsfeld should be held accountable for the torture and abuse of detainees in U.S. military custody. That was the argument made last week by the ACLU and Human Rights First before a federal court.

The hearing marked the first time a federal court has considered whether top U.S. officials can be held legally accountable for the torture scandal in Iraq and Afghanistan.

“There must be legal accountability in a court of law for high-ranking government officials who order or allow torture in violation of the most fundamental legal norms that govern our society,” said ACLU attorney Lucas Guttentag, who is lead counsel in the case. “Torture is universally prohibited but Secretary Rumsfeld and the other defendants have not been held responsible for the orders they gave and the abuse they permitted.”

The groundbreaking lawsuit was filed on behalf of nine innocent civilians who were detained by the U.S. military in Iraq and Afghanistan. While in U.S. custody, the men were subjected to abuse, torture and other cruel and degrading treatment, including severe and repeated beatings, cutting with knives, sexual humiliation and assault, mock executions, death threats, and restraint in contorted and excruciating positions. All of the men were released without charge.

Retired military officers and military legal experts have filed a legal brief in support of the lawsuit. According to the military law experts, “It was the essence of Secretary Rumsfeld and other defendants’ scope of employment to educate and train those within their command responsibility to adhere to domestic and international standards and to do everything within their power to prevent and punish deviations from them.” The experts urged that allowing the federal case to proceed would not intrude into matters of military decision-making, but would reinforce the military’s interest in command responsibility.

U.S. Subpoenas ACLU to Confiscate Document, ACLU Fights Back

The ACLU went to court this week to fight off a government subpoena demanding that we turn over to the FBI “any and all copies” of a December 2005 government document in our possession.

"The government's attempt to suppress information using the grand jury process is truly chilling and is unprecedented in law and in the ACLU's history," said ACLU Executive Director Anthony D. Romero. "This subpoena serves no legitimate investigative purpose and tramples on fundamental First Amendment rights. We recognize this maneuver for what it is: a patent attempt to intimidate and impede the work of human rights advocates like the ACLU who seek to expose government wrongdoing."

The three-and-a-half page document, issued in December 2005, is marked "Secret" and apparently is classified. The ACLU received the document, unsolicited, on October 23, 2006.

While release of the document might be "mildly embarrassing" to the government, the ACLU's possession of it is legal and its release could in no way threaten national security. To the contrary, the designation of the generally unremarkable document as "Secret" "appears to be a striking, yet typical, example of overclassification."

"No official secrets act has yet been signed into law, and the grand jury's subpoena power cannot be used to create one," said ACLU Legal Director Steven R. Shapiro. "The most significant thing about this case is not the content of the document but the government's unprecedented effort to suppress it."

If the government can enforce a subpoena in this way, it could just as easily have subpoenaed the Pentagon Papers from The New York Times and The Washington Post. The effect of the subpoena is no different than a prior restraint and it is equally unconstitutional.

We recognize this maneuver for what it is, as I'm sure you do. It's a patent attempt to intimidate and impede the work of human rights advocates like the ACLU who seek to expose government wrongdoing.

Many of the most important news articles of the past year (such as those concerning NSA eavesdropping, rendition of foreign prisoners of our nation to other nations, and Defense Secretary Rumsfeld's views on the deteriorating situation in Iraq) have been based on classified documents leaked to reporters, which could not be prepared and published as they have been were the government allowed to use subpoenas to confiscate 'any and all' copies of classified documents it learns are in the hands of journalists and other public advocates and critics.

Although the subpoena refers to the Espionage Act, the ACLU has been told that it is not a target of the investigation. "The ACLU is not a target for investigation because we have done nothing wrong," said Romero. "It is the government that is in the wrong when it abuses its power and attempts to silence its critics."

Das europäische Hauptquartier der US-Armee (EUCOM) hat bestätigt, von seinem Sitz in Stuttgart aus Gefangenentransporte nach Guantanamo organisiert zu haben. "Wir haben Gefangene transportiert, und wir haben das noch am selben Tag bekannt gegeben", sagte EUCOM-Sprecher John Tomassi der "Stuttgarter Zeitung". Das US-Militär reagierte damit auf Berichte über die Verschleppung von sechs algerischen Häftlingen. Der EUCOM-Sprecher bezog sich der Zeitung zufolge auf eine Mitteilung vom 18. Januar 2002. Darin heiße es, dass sechs algerische Terrorverdächtige von Bosnien "an einen sicheren Ort" gebracht worden seien.

As part of the same plan, Brookfield Consortium, a Canadian company, would clearcut a 1,200-mile swath through five national parks and two wilderness reserves to make way for the world's largest transmission line.

But smarter alternatives to strengthening Chile's economy -- such as stricter energy efficiency standards and the use of localized, clean and renewable energy sources -- are readily available.

Chile's new president, Michelle Bachelet, has pledged to make environmental protection a priority in her administration. To fulfill that promise, she should take a hard a look at every possible alternative before sentencing wild Patagonia to electrocution.

Ugandan President Yoweri Museveni is pursuing legally dubious plans to destroy much of Uganda's last few rainforests to grow palm oil and sugar cane crops. Uganda has long been facing a deforestation crisis, with forests covering 20 percent of Uganda 40 years ago, but now just covering seven percent. The plans targets two forested areas: 10,000 hectares on the island of Bugala on Lake Victoria for oil palm by a company named Bidco; and 7,000 hectares, some one-third of Mabira Forest Reserve which has been protected since 1932, for sugar cane production by the Mehta Group.

Loss of forest cover in Uganda has had devastating ecological impacts which will be intensified by the proposed projects. Deforestation has been directly responsible for declining levels of waters in Lake Victoria, River Nile and other rivers resulting in a scarcity of drinking water and reduction in hydroelectric energy production. Local environmentalists say destroying Uganda's surviving forests could have further grave ecological consequences -- threatening hundreds of rare species, sparking soil erosion and removing a crucial buffer against pollution of Lake Victoria. Local people are critically dependent upon remaining forests for firewood and building houses.

According to Uganda’s National Forest Authority (NFA), the plan to log Mabira reserve endangers 312 species of tree, 287 species of bird and 199 species of butterfly. Nine species found only in Mabira and nearby forests risked going extinct. The forest absorbs pollution in an industrial area, sinking millions of tonnes of carbon dioxide, and helps maintain central Uganda's wet climate. Their removal would bring drier weather and hurt crop yields. Mabira is a watershed for two rivers contributing to the Nile, an ecological stabiliser between two major industrial towns and it protects Lake Victoria. According to the Uganda Tourism Board, eco-tourism generated some $300 million for Uganda last year.

At the end of November, more than 2,000 protesters from Uganda, the United States, Israel and other places signed a petition urging President Museveni not to parcel out land from the Mabira Forest Reserve. Local NGOs have described the situation - with the President questionably pushing the projects while the parliament remains largely silent - "as a governance crisis, disrespect for constitutionalism and the rule of law… forest reserves are protected by the constitution and environmental laws and that change of land use can only be approved by Parliament… ongoing actions also question Uganda's commitment to respect international law and obligations."

The whole matter seems to reflect a desperate power grab by the President to reward cronies under false and illusory promises of industrialization. The government has no legal mandate to give out constitutionally protected forest reserves to be cut down by private companies. Recently the president asked the NFA boss to do just that, and forced him to resign after he refused to license the rainforest destroying palm oil development.

Please contact President Yoweri Museveni, the entire Ugandan parliament, and Ugandan ministries and embassies and insist that these projects be abandoned, and Uganda's remaining rainforest strictly protected as ecological reserves while restoring forests where they historically occurred.
