Indeed, why cannot he protect us from threats that were of widespread public knowledge, like Hurricane Katrina?

Keine Mobilfunkantenne beim «Tunneli» in Lommiswil. Das Verwaltungsgericht entschied gegen die Baukommission sowie das Bau- und Justizdepartement. Das Bahntrassee, neben dem die Antenne gebaut werden sollte, liege nicht in der Bauzone.

Die drei Gesuchsteller Swisscom Mobile AG, TDC Schweiz AG sunrise und Orange Communications SA sowie die Baukommission und das BJD betrachteten das Areal um die Bahnstrecke, das im Zonenplan als «weiße, also unbehandelte Verkehrsfläche» erscheint, als Bauzone.

In dieser wäre die Installation einer Mobilfunkantenne zulässig. Außerhalb der Bauzone ist eine Ausnahmebewilligung nötig. Der Regionalverkehr Mittelland (RM) als Landbesitzer hatte überdies erklärt, dass er seinen Funkverkehr ebenfalls über diese Antenne abwickeln wolle.

«Weit entfernt von der Bauzone»

«Vorliegend handelt es sich um ein Bahnareal, das weit entfernt von der Bauzone in der Landwirtschaftszone liegt», schreibt das Verwaltungsgericht in seinem Urteil. Die Antenne soll nicht im Bahnhofareal gebaut werden, sondern im Bahntrassee auf dem freien Feld zwischen zwei Siedlungen.

Zwar sei das Gebiet für den Bahnbetrieb mit einer Straßenüberführung überbaut worden, es handle sich aber um ein Gebiet, auf dem keine Hochbauten stehen. «Die Bauparzelle liegt inmitten landwirtschaftlicher Flächen und im Richtplan ist sie keinem Siedlungsgebiet zugeordnet», schreibt das Gericht.

Antenne ist nur eine Nebenanlage

Da der RM die Antenne auch für seinen eigenen Funkverkehr nutzen will, stellte sich die Frage, ob die Antenne als Eisenbahn- oder Nebenanlage dient. Für Eisenbahnanlagen ist der Bund zuständig, weil diese unter das Eisenbahngesetz fallen. Nebenanlagen, die nicht ganz oder überwiegend dem Bahnbetrieb dienen, unterstehen dem kantonalen Bau- oder Planungsrecht.

Dies können Bauvorhaben der Bahn oder Dritter sein. Und: Sie gehören in die Bauzone. Das Gericht kam zum Schluss, dass die Antenne primär die Allgemeinheit mit Telefonverbindungen versorge. «Es handelt sich nicht um eine bahnbetrieblich nötige Anlage.»

«Präventiv Einsprache erheben»

Friedrich Brotschi, einer der Beschwerdeführer aus Selzach, ist über das Urteil des Verwaltungsgerichts erfreut. «Es ging mir nicht um die Strahlung oder so etwas, sondern ums Prinzip. Der Juraschutzzone wurde zuvor zu wenig Bedeutung eingeräumt», erklärt der frühere Präsident der Planungskommission Selzach.

Weniger glücklich über das Urteil ist Meinrad Engesser, Präsident der Baukommission Lommiswil: «Wir werden präventiv Einsprache beim Bundesgericht mit Fristerstreckung erheben. Dann werden wir die rechtliche Lage mit unserem Anwalt erörtern und das weitere Vorgehen besprechen.»

Engesser ist jedoch pessimistisch: «Wir bräuchten vor Bundesgericht wohl neue Argumente, über die das Verwaltungsgericht noch nicht entscheiden konnte, um zu bestehen. Ich glaube daher nicht an eine große Chance.» (mz/ms/pbl)

The relentless proliferation of microwave wireless technology in Brighton really worries me.

The latest of thousands of independant scientific papers showing widespread health damage from this technology is analysed by Lloyd Morgan, a Director of the US Central Brain Tumor Registry (see http://www.powerwatch.org.uk ) ; a study of "the worst type of brain tumors: those collectively referred to as "brain cancer" (e.g., gliomas, astrocytomas, glioblastoma multiforme--AKA GBM--etc.)" by research team Hardell et al.

The study examined 905 cases of these brain tumors, ages 20 to 80, diagnosed between 1997 and 2003, with 2162 controls. All the teams' previous 12 studies had found increased risks from wireless (Mobile, Analog and DECT) phones.

He continues: "The survival statistics for these tumors are very grim (e.g., one year GBM survival is 29%) and the devastating effects, even if there is survival, can be heartbreaking including loss of physical, emotional and mental abilities"

The study found the risk increased by an average of 25% below 1000 hours of phone use, to 130, 270 and 490% for 2 - 3000 hours for DECT, Cell and Analog phones respectively, and by 20% (all types) for 1 - 5 years use, to 80% (DECT), 140% (Analog) and 180% (mobile) after 10 years.

Morgan states:"the most troubling aspect of the Hardell et al. study is that of the early latency times it is demonstrating with regards to cellphone exposure. It is well known that the time from exposure to a carcinogen to the diagnosis of a tumor takes decades (25 to 40 years), yet we are seeing an increased risk of brain cancer for as short as 1 to 5 years.."

"Could the implication be then, that what we are seeing is actually the tail of a 25 to year latency time distribution?"

I am reminded of the words of Dr Leif Salford, head of a major study into cell phone use in Sweden in the late 1990s, who said "Brain damage from intensive cell phone use is a probability rather than a possibility"

And with researchers worldwide warning particularly against cell phone use by under 16s, I see a very grim future for todays' children.

Protesters defeated but campaign goes on

CAMPAIGNERS have lost their fight against a mobile phone giant and its controversial mast.

Workers for T-Mobile have almost finished putting the mast up on the corner of St Paul's Wood Hill and Beddington Road, St Paul's Cray.

Security guards kept watch at the site last night after angry scenes yesterday when anti-mast protestors - who have fought a six-month battle against the development - attempted to tear barricades down.

Workers arrived early this morning and installed the electronic equipment needed for the mast to work.

Campaigner Sam Anderson, 35, said: "We're all pretty gutted.

"It is just amazing that T-Mobile goes to such an extent to have security guards there overnight and to double barricade themselves in.

"Surely that means nobody wants it."

The mother-of-three is now focusing her attention on organising a mass march through central London to Downing Street.

She is currently waiting for a call from the Met Police to finalise a date for the protest which she hopes will take place as soon as the House of Commons meets after the summer recess.

Where there’s fire, there’s global warming

"I think there was a tendency to think that the overwhelming factor
(driving forest fires) was short-term weather. There’s this idea that drought matters, and it does. But it’s taking time and a lot of research to show that climate plays a big role as well." -- Anthony Westerling

Six years ago, climate scientist Anthony Westerling began obsessively poring over the meticulously detailed invoices that U.S. Forest Service and National Park Service land managers use to itemize firefighting expenses.

"These things will have 170-plus fields," says Westerling — including information on when a fire was first reported, when firefighters finally controlled it, and how many acres were burned. Westerling, who works at the Scripps Institution of Oceanography (which also studies climate and earth sciences) in La Jolla, Calif., didn’t aspire to be an accountant, nor was he searching for fraud in government spending. He was hoping to answer a question that had not been seriously asked before: How do rising global temperatures affect wildfire behavior?

Along with fellow researchers in La Jolla and at the University of Arizona in Tucson, Westerling wove the information in the invoices together with data from streamflow gauges, soil moisture measures, and temperature and precipitation records to form a comprehensive picture of the driving forces behind the West’s fires.

The group will present its findings in the journal Science next month; a preliminary article appeared in the July 6 issue of Science Express. The basic conclusion may not startle: Large forest fires increased beginning in the mid-1980s — particularly in the Northern Rockies, the Sierra Nevada and the southern Cascades — and the changes closely correlated with an increase in spring and summer temperatures during the same time period.

But some of the nuances are surprising. Westerling and his colleagues found that a delicate "tipping point" exists, particularly in forests in the Northern Rockies and Northern California. When snowpack melts earlier in the spring — even just a few days sooner — the severity of the fire season intensifies greatly. "It didn’t take a very big temperature increase (to) switch from very few fires to a lot of fires," says Westerling. As spring and summer temperatures gradually increased, "You were getting closer and closer to this tipping point, so that the (climate) variability from year to year just pushes you over it easily."

Westerling grew up in Los Angeles but vacationed at a family cabin on the east side of the Sierra, and later lived abroad in places like Saudi Arabia, China and Brazil. He returned to California to get his Ph.D., and in 2000, he went to work at Scripps. That year proved to be a banner one for fire, and that’s when Westerling began looking more closely at the relationship between climate and fire.

Because of the wide variability in fire regimes throughout the West — from ponderosa forests in the Southwest to chaparral in Southern California to lodgepole pine and spruce-fir forests in the Northern Rockies — long-term trends can be hard to pick out from the year-to-year "noise."

That was precisely the value of Westerling’s research: Zooming out to look at the entire region helped bring the phenomenon into relief.

Usually, blame for the bigger and more frequent fires of the past 20 years is ascribed to the federal government’s aggressive firefighting policies, which have left a lot of dead and small-diameter trees in Western forests ready to burn. Westerling’s research suggests that rising temperatures, not land-management practices, may play a greater role in driving forest fires.

But, he writes, if warming is the main driver of increased fire activity, "ecological restoration and fuels management alone will not be sufficient to reverse current wildfire trends." Scientists and planners must also plug global climate change into their equations.

In truth, Olympia Snowe is a Bush-enabler who fully supports the Iraq war, the PATRIOT Act, anti-choice federal judges who would dismantle Roe v. Wade, tax cuts for the rich, elimination of the estate tax, and reduction of benefits to returning veterans, including protection from bankruptcy for the families of veterans serving in Iraq and Afghanistan. Olympia Snowe opposes universal health care and opposes making the minimum wage a living wage. Her campaign is funded by contributions from defense contractors, oil companies, credit card companies, HMOs and drug companies. Her campaign, her votes and the philosophy behind them is one of destroying the average working family while working to widen the income gap in America.

Democrat Jean Hay Bright is a true grass-roots progressive. She wants to get U.S. troops and corporations out of Iraq, institute national health care, make the United States sustainably energy independent, rebuild American infrastructure and manufacturing capacity, and restore fiscal responsibility in Washington.

Maine is a small state, a blue state that supported Clinton, Gore and Kerry. Jean can win this election with 350,000 votes and only million. Her campaign has already brought unenrolled, disenfranchised Democrats back into the party. She has strong support from Democrats within the state. But the cupboard is bare, and she needs your help.

As Snowe's first women opponent, and with Snowe having voted for Alito, thousands of Democratic women who have voted for Snowe in the past will this year vote for Jean. As a commercial organic farmer, Jean has strong support in the agriculture community, and with the Maine Green Party, which is not running a U.S. Senate candidate in this race.

Recent surveys show 75 percent of Maine voters don't think the Iraq war is worth the cost and casualties it has produced. Jean's anti-war credentials are as good as those of Kucinich, Feingold, Conyers, or Lamont. She also has the support of many veterans and veterans groups, who know she will fight for veteran's rights and health care.

There is a perfect storm brewing this year, forging a movement to oust the Republican ideology that is destroying the fabric of our nation. People are beginning to understand that for many reasons, from national security to individual freedom, this country needs to replace six sitting Republicans senators with six Democrats.

The final days of Arizona's final free-flowing river

Robin Silver is in the business of saving lives, which, as legacies go, is better than most. But it isn't enough. Not for him.

He also wants to save the planet, or at least one or two of its most beautiful spots, which happen to exist here in Arizona.

So when he isn't working as a physician, Silver heads up the Tucson-based Center for Biological Diversity. I first spoke to him last July about a catastrophic event in our state that none of us noticed, and which we wouldn't have cared about even if we had.

For the first time in 75 years, stream flow in southern Arizona's San Pedro River had shrunk to zero. The 140-mile river flows north from Mexico into Arizona, passing east of Tucson and meandering to Sierra Vista.

It's the last free-flowing river in the Southwest and has been a source of life in the desert for thousands of years. The cottonwood, willow and mesquite trees along the riverbank provide shelter for 400 species of birds and other animals, as well as over 100 species of butterflies.

Imagine that. One hundred different kinds of butterflies.

The Nature Conservancy has called the San Pedro one of the "last great places" on Earth, but on July 5, 2005, the most sensitive stream flow gauge on the river registered zero. For a short stretch downstream of Sierra Vista, the river dried up.

At the time, Silver was hoping that the no-flow event would be a wake-up call for the politicians whom he says are allowing unchecked development to slowly kill one of the most lovely places on the planet.

Naturally, he was wrong.

Birds and butterflies rarely appear on the campaign contribution lists of political candidates. Unlike developers.

"I've been in this business a long time," he told me last week. "But our group (the center has 25,000 members) is not going away. We owe it to our children that rivers like the San Pedro be protected. It isn't just about preserving a beautiful spot, it's also about being wise not to squander the desert's most valuable resource: water."

Last week, Silver sent out a lengthy e-mail pointing out yet another catastrophic event in Arizona that none of us noticed, and which we wouldn't have cared about even if we had.

On June 29, a portion of the San Pedro dried up - again. It was the second time that such a thing had occurred in 75 years, and less than a year from the first time.

"We have had multiple 'proclamations' from different governors about how important the rivers are," he said. "But when it comes down to it, we just go along with the flow of development and don't protect the public trust."

Right now, he said the biggest threats to the San Pedro are new housing around Sierra Vista and the drain on resources from nearby Fort Huachuca.

"There are laws in place that, if they were enforced, would do much to solve this problem," Silver said. "It's all about restricting development based on water."

As with every other scientific debate, however, there are experts who will side with developers and with elected officials looking to expand their political base. They'll say the river is fine.

Still, Silver again is hoping that when a no-flow event that hasn't happened in 75 years happens again, that it will be a wake-up call. Again.

"To us, it seems like a slow process," he said. "It isn't. And shame on us if in a few decades the river is dry and someone has to tell people living in these developments to turn off their spigots."
